Petitioners
\n\thave challenged various orders passed by the Courts below. However,
\n\tthe main challenge is to an order dated 1.8.2008 passed by Principal
\n\tDistrict Judge, Porbandar passed in Civil Misc. Application No.1 of
\n\t2008 by which the said application of the petitioners came to be
\n\tdismissed.\n<\/p>\n
The
\n\tlitigation has a longish history. Respondent herein is an employee
\n\tof the erstwhile Junagadh District Panchayat. He had filed a Civil
\n\tSuit seeking regularization employment being Regular Civil Suit
\n\tNo.76 of 1987, After the suit was dismissed, the employee filed
\n\tRegular Civil Appeal No.15 of 1989 before the appellate Court which
\n\tdisposed of appeal in following terms:\n<\/p>\n
ORDER<\/p>\n
 The
\n\tpresent appeal is hereby partly allowed.\n<\/p>\n
\tThe respondents
\n\tare hereby ordered to give opportunity of being selected though due
\n\tprocedure to the plaintiff and till the compelition of said
\n\tprocedure they shall not terminate the services of the plaintiff.
\n\tThe respondents are hereby ordered to regularize the services of the
\n\tplaintiff after following due procedure.\n<\/p>\n
\tJudgment and
\n\tdecree passed by the learned trial Judge is modified accordingly.\n<\/p>\n
\tParties to bear
\n\ttheir own costs of this appeal.\n<\/p>\n
\tDecree be drawn
\n\taccordingly.\n<\/p>\n
\tPronounced in
\n\topen Court to day this 12th day of April, 1991 at
\n\tPorbandar .\n<\/p>\n
\tIt is not in
\n\tdispute that the above directions of the appellate Court have so far
\n\tnot been implemented. The employee, therefore, preferred execution
\n\tproceedings and his execution application No.7 of 1993 came to be
\n\tdisposed of by an order dated 10.2.2005 passed by learned Principal
\n\tSenior Civil Judge, Probandar. On the said application learned Judge
\n\tpassed an order dated 10.2.2005 and directed the appellants herein
\n\tto file a report whether the judgment has been complied with or not.
\n\tUltimately, the learned Judge passed an order dated 30th
\n\tSeptember, 2005 and gave following directions:\n<\/p>\n
\tORDER<\/p>\n
\t The
\n\tapplication Exh.13 is hereby allowed.\n<\/p>\n
\tThe defendants
\n\tare directed that earlier this Court has given the direction on
\n\t10.2.2005 to the defendants to follow same strictly as well as the
\n\tdirection given by the Appellate Court in R.C.Exe.No.15 of 1989
\n\twithin three months from the date of this order and the defendants
\n\tare also directed to produce his compliance report before this Court
\n\ton or before 31.12.2005 in view of above.\n<\/p>\n
\tYadi be sent to
\n\tthe defendant.\n<\/p>\n
\tNo order as to
\n\tcost of this application.\n<\/p>\n
\tPronounced in
\n\topen Court today .\n<\/p>\n
\tAgainst the said
\n\torder dated 30th September, 2005, the petitioners herein
\n\tpreferred Special Civil Application No.25844 of 2006 in which
\n\tinitially while issuing notice on 12th December, 2006,
\n\tstay also came to be granted in favour of the petitioners. The
\n\tpetition, however, came to be disposed of by an order dated
\n\t27.11.2007. The petitioners were permitted to withdraw the petition
\n\tfor availing alternative remedy and petitioners were directed to pay
\n\tcost of Rs.5,000\/-.\n<\/p>\n
\t4.1\tUpon this
\n\tCourt disposing of Special Civil Application No.25844 of 2006 in
\n\tabove manner, the petitioners preferred Civil Misc. Application No.1
\n\tof 2008 before the District Court which came to be disposed of by
\n\tthe impugned order dated 1.8.2008 and by the said order, the
\n\tDistrict Court while rejecting the application of the petitioners
\n\trequired that the execution be proceeded expeditiously. At that
\n\tstage, the petitioners have approached this Court.\n<\/p>\n
\tIt is not in
\n\tdispute that the order passed by the appellate Court on 12th
\n\tApril, 1991 in favour of the respondent herein has become final and
\n\twas never challenged. Thus, since 1991, the respondent was directed
\n\tto be considered for regularization and it was provided that he
\n\tshall be regularized in service after following due procedure.
\n\tAdmittedly, so far these steps have not been taken by the
\n\tpetitioners. On behalf of the petitioners it was, however, contended
\n\tthat earlier for want of vacancy and thereafter, on account of ban
\n\tfrom the Government, the petitioners have not undertaken any
\n\trecruitment process. Therefore, the directions could not be complied
\n\twith.\n<\/p>\n
\tDuring the
\n\tpendecy of the above proceedings, the new district of Porbandar has
\n\tbeen created and it is not in dispute that certain vacancies have
\n\tarisen. Even otherwise, it was impossible to believe that it was not
\n\tpossible to comply with order for a period of nearly 18 years, and
\n\tthere were no retirements, termination, resignation or dismissals.
\n\tUpon reading the directions of the appellate Court, it is clear that
\n\tregularization of the respondent herein was not linked necessarily
\n\twith the petitioners undertaking regular selection. The case of
\n\tregularization of the respondent was to be taken up as directed by
\n\tthe Court and if it was necessary, the petitioners should have done
\n\tso separately. Insofar as the defence of the petitioner for not
\n\tcomplying with the directions of the appellate Court is concerned, I
\n\ttherefore see no validity. The impugned order dated 1.8.2008,
\n\ttherefore, suffers from no illegality. The petition deserves to be
\n\tdismissed.\n<\/p>\n
\tLearned advocate
\n\tfor the petitioners, however, submitted that Courts below are
\n\tpressing hard for execution of the orders. He, therefore, prayed
\n\tthat sometime be granted to the petitioners to comply with the
\n\tdirections. This request is accepted. The petitioners shall have
\n\ttime upto 31st December, 2008 to complete the procedure
\n\tand fully comply with the directions of the Courts below.\n<\/p>\n
\tThe petition is
\n\tdisposed of accordingly.\n<\/p>\n
