Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/05\/2009\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          W.P.(C).No.13607    OF 2009\n          ===========================\n\n      Dated this the 22nd day of May,2009\n\n                   JUDGMENT\n<\/pre>\n<p>    Petitioner   filed   W.P.(C)8379\/2009   for<\/p>\n<p>adequate protection for conducting quarrying<\/p>\n<p>and transport of laterate building stone, earth<\/p>\n<p>and mud alleging interference and intervention<\/p>\n<p>by the fourth respondent in the Writ Petition.<\/p>\n<p>As  per  Ext.P1   order,  the  Division   Bench<\/p>\n<p>directed that if a written request is made by<\/p>\n<p>the petitioner to the Sub Inspector of Police,<\/p>\n<p>the third respondent in the Writ Petition,<\/p>\n<p>against any physical obstruction caused to the<\/p>\n<p>work carried out by him, the Sub Inspector<\/p>\n<p>shall visit the premises and if he is satisfied<\/p>\n<p>that  such  obstruction  is  caused,  necessary<\/p>\n<p>protection shall be afforded.  It is also made<\/p>\n<p>clear that petitioner shall ensure that the<\/p>\n<p>tipper lorry carrying the load shall not be run<\/p>\n<p><span class=\"hidden_text\">W.P.(C) 13607\/2009             2<\/span><\/p>\n<p>at high speed and the speed shall be limited to 35<\/p>\n<p>k.m per hour and the road being a mud road,<\/p>\n<p>petitioner        shall  sprinkle  water  on  the   road.<\/p>\n<p>Ext.P1 order was passed on 24.3.2009. Subsequently<\/p>\n<p>second respondent, the Sub Divisional Magistrate,<\/p>\n<p>Chengannur, issued Ext.P2 preventive order under<\/p>\n<p>section 144(1) of the Code of Criminal Procedure<\/p>\n<p>prohibiting        demolition of  hills or filling up of<\/p>\n<p>paddy fields for the period from 24.4.2009 to<\/p>\n<p>31.5.2009.        Ext.P2 order itself makes it absolutely<\/p>\n<p>clear that the said preventive order is not valid<\/p>\n<p>in respect of          sunami works as well as      works<\/p>\n<p>sanctioned by the court.          Petitioner filed this<\/p>\n<p>petition under Article 226 of the Constitution of<\/p>\n<p>India to quash Ext.P2 contending that           it is in<\/p>\n<p>violation       of   Ext.P1  judgment  and  also  for   a<\/p>\n<p>direction not to implement Ext.P2 order in respect<\/p>\n<p>of the work       under Ext.P1 judgment.<\/p>\n<p>     2.          Learned   counsel  appearing   for   the<\/p>\n<p>petitioner and          learned Public Prosecutor were<\/p>\n<p><span class=\"hidden_text\">W.P.(C) 13607\/2009            3<\/span><\/p>\n<p>heard.\n<\/p>\n<p>     3. As is clear from Ext.P2 order itself,       the<\/p>\n<p>preventive        order is not valid in respect of the<\/p>\n<p>works permitted by the court.          Therefore Ext.P2<\/p>\n<p>order cannot be in violation of Ext.P1 order passed<\/p>\n<p>by this court,        when Ext.P2 itself makes it clear<\/p>\n<p>that it is not valid in respect of works sanctioned<\/p>\n<p>by the court.
