Sanjay Prajapati\n    Both sons of Munna Prajapati.Both resident     of village-\n    Lamura, Police Station-Kochas(Parsathuan), District-Rohtas\n                                 Versus\n                           STATE OF BIHAR .\n                              -----------\n<\/pre>\n<p>2    14.06.2010                Heard    learned      counsel     appearing       on<\/p>\n<p>                  behalf of the petitioners and learned counsel<\/p>\n<p>                  appearing on behalf of the State.<\/p>\n<p>                               The petitioners herein are accused in<\/p>\n<p>                  connection     with     Kochas(Parsathuan)          P.S.      Case<\/p>\n<p>                  No. 131\/09 (S.Tr. No. 177 of 2010) for offences<\/p>\n<p>                  punishable     under     Sections      302\/201\/34        of    the<\/p>\n<p>                  Indian Penal Code.\n<\/p>\n<p>                               The petitioners have been charged of<\/p>\n<p>                  being a party to the death of the sister of the<\/p>\n<p>                  informant, Asarfa Devi who was married to co-<\/p>\n<p>                  accused Anil Prajapati.\n<\/p>\n<p>                               Learned     counsel      for    the    petitioner<\/p>\n<p>                  submits      that     these    two     petitioners       Ramesh<\/p>\n<p>                  Prajapati     and     Sanjay    Prajapati      are      sons    of<\/p>\n<p>                  Munna      Prajapati,    the    elder       brother     of     the<\/p>\n<p>                  husband of the deceased.              He submits that the<\/p>\n<p>                  deceased      was     earlier        married       to   Awadesh<\/p>\n<p>                  Prajapati and after his death she got married<\/p>\n<p>                  to   the    younger     brother,     Anil    Prajapati.        The<\/p>\n<p>                  cause of death has been attributed                  to certain<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>property disputes.\n<\/p>\n<p>             Learned         counsel        for       the    petitioner<\/p>\n<p>relying upon an order passed by this Court in<\/p>\n<p>Cr.Misc.     No.    10314           of     2010       and   Cr.      Misc.<\/p>\n<p>No. 16645 of 2010 dated 7.5.2010 submits that<\/p>\n<p>most of the accused persons have been granted<\/p>\n<p>bail    by   a     Bench       of        this     Court     and      these<\/p>\n<p>petitioners       who        are    based        in    Katani     in   the<\/p>\n<p>State of Madhya Pradesh are sons of the own<\/p>\n<p>brother.     He submits that there is no direct or<\/p>\n<p>indirect allegation against these petitioners<\/p>\n<p>nor there is any materials connecting them to<\/p>\n<p>the alleged occurrence.\n<\/p>\n<p>             Having          regard        to     the       submissions<\/p>\n<p>aforesaid, let the petitioners namely, Ramesh<\/p>\n<p>Prajapati and Sanjay Prajapati be released on<\/p>\n<p>bail upon each of them furnishing individual<\/p>\n<p>bail bonds of Rs. 10,000\/- with two sureties of<\/p>\n<p>the like amount to the satisfaction of learned<\/p>\n<p>4th    Additional            District           Judge,      Rohtas      at<\/p>\n<p>Sasaram in connection with Kochas (Parasathuan)<\/p>\n<p>P.S.    Case      No.131           of     2009    subject       to     the<\/p>\n<p>following        conditions:-(i)                That     one    of     the<\/p>\n<p>bailors      will       be     a        close    relative       of     the<\/p>\n<p>petitioners who will give an affidavit giving<\/p>\n<p>genealogy as to how he is related with the<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>          petitioners.        The bailor will also undertake to<\/p>\n<p>          inform the court if there is any change in the<\/p>\n<p>          address   of    the       petitioners.
