Desai waives service of notice of Rule for the<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.258\/2010 with Dabhoda Police Station, Gandhinagar for the<br \/>\n\toffences punishable under Sections 420, 465, 467, 468, 471, 114 and<br \/>\n\t120B of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the applicants submits that the<br \/>\n\tco-accused has been enlarged on bail and the applicants are<br \/>\n\tsimilarly situated facing similar accusations and by imposing<br \/>\n\tsuitable conditions,  the applicants may be granted<br \/>\n\tanticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, I am<br \/>\n\tinclined to grant anticipatory bail to the applicants.  This Court<br \/>\n\thas also taken into consideration the law laid down by the Apex<br \/>\n\tCourt in the case of <a href=\"\/doc\/1108032\/\">Siddharam Stalingappa Mhetre v. State of<br \/>\n\tMaharashtra &amp; Ors.<\/a> reported in [2011]1 SCC 694,<br \/>\n\twherein the Apex Court reiterated the law laid down by the<br \/>\n\tConstitutional Bench in the case of Shri Gurubaksh Singh<br \/>\n\tSibbia &amp; Ors. reported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicants herein being arrested pursuant to FIR being<br \/>\n\tI-C.R. No.258\/2010 with Dabhoda Police Station, Gandhinagar, the<br \/>\n\tapplicants shall be released on bail on furnishing a bond of<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand Only) each with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p>(a) shall cooperate with the<br \/>\ninvestigation and make themselves available for interrogation<br \/>\nwhenever required;\n<\/p>\n<p>(b) shall remain present at the<br \/>\nconcerned Police Station on 6th<br \/>\nAPRIL, 2011 between 11.00 am to 2.00 pm;\n<\/p>\n<p>(c) shall not hamper the<br \/>\ninvestigation in any manner nor shall directly or indirectly make any<br \/>\ninducement, threat or promise to any witness so as to dissuade them<br \/>\nfrom disclosing such facts to the Court or to any Police Officer;\n<\/p>\n<p>(d) shall at the time of<br \/>\nexecution of bond, furnish the address\tto the Investigating Officer<br \/>\nand the Court concerned and shall not change the residence till the<br \/>\nfinal disposal of the case or till further orders;\n<\/p>\n<p>(e) will not leave India without<br \/>\nthe permission of the Court and, if is holding a Passport, shall<br \/>\nsurrender the same before the trial Court immediately;\n<\/p>\n<p>(f) It would be open to the<br \/>\nInvestigating Officer to file an application for remand, if he<br \/>\nconsiders it just and proper and the concerned Magistrate would<br \/>\ndecide it on merits.\n<\/p>\n<p>(g) despite this order, it would<br \/>\nbe open for the Investigating Agency to apply to the competent<br \/>\nMagistrate, for police remand of the applicants.  The applicants<br \/>\nshall remain present before the learned Magistrate on the first date<br \/>\nof hearing of such an application and on all subsequent occasions, as<br \/>\nmay be directed by the learned Magistrate.  This would be sufficient<br \/>\nto treat the accused in the judicial custody for the purpose of<br \/>\nentertaining application of the prosecution for police remand.  This<br \/>\nis, however, without prejudice to the right of the accused to seek<br \/>\nstay against an order of remand, if ultimately granted, and the power<br \/>\nof the learned Magistrate to consider such a request in accordance<br \/>\nwith law.  It is clarified that the applicants, even if, remanded to<br \/>\nthe police custody, upon completion of such period of police remand,<br \/>\nshall be set free immediately, subject to other conditions of this<br \/>\nanticipatory bail order.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
