Justice K.HEMA\n\n Dated :09\/07\/2008\n\n O R D E R\n                            K.HEMA, J.\n                 --------------------------------------\n                  Bail Application No.4032 of 2008\n                 ---------------------------------------\n                 Dated this the 9th day of July, 2008\n\n\n                              O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2.   The alleged offences are under Sections 143, 147,<\/p>\n<p>149, 365, 373, 506(1), 342, 465 and 330 of IPC. According to<\/p>\n<p>the prosecution, the alleged victim is a former employee who<\/p>\n<p>worked in the Medical Shop of the second accused.          On the<\/p>\n<p>allegation that he committed misappropriation of about Rs.3<\/p>\n<p>lakhs from the Medical Shop, he was abducted by the petitioner&#8217;s<\/p>\n<p>son who is the first accused and four others and he was brought<\/p>\n<p>to Kaikkara. From there, the alleged victim was questioned by<\/p>\n<p>other persons and he was asked to return the money.          The<\/p>\n<p>petitioner was allegedly present on the scene and he also asked<\/p>\n<p>the person to return the money and he also beat him with hand.<\/p>\n<p>Thereafter, he was taken to the house of the second accused and<\/p>\n<p>the victim&#8217;s parents were called to the place and victim was<\/p>\n<p>handed over to them on the next day. These are the allegations<\/p>\n<p>in short.\n<\/p>\n<p>      3.   Learned counsel for the petitioner submitted that<\/p>\n<p><span class=\"hidden_text\">BA No.4032\/08                    2<\/span><\/p>\n<p>going by the allegations in the First Information Statement, the<\/p>\n<p>petitioner has not taken part in abduction.      The petitioner is<\/p>\n<p>totally innocent of the allegations made and he has not taken<\/p>\n<p>part in the offence, it is submitted. But, he is implicated only<\/p>\n<p>because he is the owner of the shop.\n<\/p>\n<p>      On hearing both sides, I am satisfied that the petitioner can<\/p>\n<p>be granted anticipatory bail and the following order is passed:<\/p>\n<blockquote><p>      (i)  Petitioner    is directed  to  surrender    before   the<\/p>\n<p>           Investigating officer from the date of this order and<\/p>\n<p>           make himself available for interrogation.<\/p>\n<\/blockquote>\n<blockquote><p>     (ii)  Thereafter, in the event of the arrest of the petitioner,<\/p>\n<p>           if any, he shall be released on bail on his executing<\/p>\n<p>           bond for Rs.25,000\/- with two solvent sureties each<\/p>\n<p>           for the like sum to the satisfaction of the arresting<\/p>\n<p>           officer on condition that he will co-operate with the<\/p>\n<p>           investigation and report before the Investigating<\/p>\n<p>           officer as and when directed.\n<\/p><\/blockquote>\n<blockquote><p>      The petition is allowed.<\/p><\/blockquote>\n<p>                                                 K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court S.
