Justice K.K.DENESAN\n\n Dated :30\/11\/2006\n\n O R D E R\n                            K.K.DENESAN, J.\n\n                    -----------------------------\n\n                       WP(C)No. 26886 OF 2006 A\n\n                    -----------------------------\n\n                 Dated this the 30th November, 2006.\n\n\n\n                                JUDGMENT\n<\/pre>\n<p>      Rank   list   published   by   the   Commission   for   appointment<\/p>\n<p>to   the   post   of   Junior   Health   Inspector   Gr.II   in   Kollam<\/p>\n<p>district   came   into   force   with   effect   from   28.10.2002.     The<\/p>\n<p>maximum period for which the rank list can be kept alive is<\/p>\n<p>over by 27.10.2005.   The petitioner says that having regard<\/p>\n<p>to the number of vacancies  reported, he was entitled to be<\/p>\n<p>advised   for   appointment,   considering   his   rank   position.\n<\/p>\n<p>The   Public   Service   Commission   was   therefore   directed   to<\/p>\n<p>furnish   the   relevant   particulars   regarding   the   number   of<\/p>\n<p>vacancies   reported   and   the   number   of   candidates   advised<\/p>\n<p>from the list.\n<\/p>\n<p>      2.        Counsel   for   the   Commission   submits   that   143<\/p>\n<p>vacancies have been reported from the department for advise<\/p>\n<p>of candidates and the Commission has advised 140 candidates<\/p>\n<p>from   the   rank   list.     It   is   also   submitted   that   candidates<\/p>\n<p>could   not   be   advised   against   three   vacancies   since   none<\/p>\n<p>belonging   to   the   particular   reserved   community   was<\/p>\n<p>available in the list.  Therefore, in terms of Rules 14 and<\/p>\n<p>15   of   K.S   &amp;   S.S.R   as   amended,   those   vacancies   are   kept<\/p>\n<p>unfilled.     Candidates   can   be   advised   against   the   above<\/p>\n<p>three vacancies only from the next list provided candidates<\/p>\n<p><span class=\"hidden_text\">WPC 26886\/2006                     2<\/span><\/p>\n<p>belonging   to   the   particular   reserved   communities   find   a<\/p>\n<p>place in that list.\n<\/p>\n<p>      3.     Considering   the   rank   position   of   the   petitioner<\/p>\n<p>there   is   no   chance   of   he   being   advised   for   appointment<\/p>\n<p>against   the   vacancies   thus   reported.         This   being   the<\/p>\n<p>factual   position,   the   directions   sought   for   in   this   writ<\/p>\n<p>petition   cannot   be   issued.
