M.S.SHAH)<\/p>\n<p>\t\tIn<br \/>\nthis appeal under section 15 of the Letters Patent, the original<br \/>\npetitioner has challenged the judgment dated 04.07.2008 of learned<br \/>\nsingle Judge rejecting the petition which was filed against<br \/>\nnotification dated 23.6.2008 of the State Government nominating a<br \/>\ncouncillor of Idar Municipality on the Agricultural Produce Market<br \/>\nCommittee (APMC), Idar.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner was elected as a member of Idar Municipality in the year<br \/>\n2003. As a councillor of Idar Municipality, the petitioner was<br \/>\nnominated by the municipality to be a member of  APMC, Idar, on<br \/>\n15.3.2007. Thereafter, the term of the municipality came to an end on<br \/>\n11.3.2008 by efflux of time.  In the election of the new body, the<br \/>\npetitioner  was re-elected.\n<\/p>\n<p>3.\t\tBy<br \/>\nletter dated 26.5.2008, the APMC requested Idar Municipality to<br \/>\nnominate a councillor on  APMC, Idar as required under the provisions<br \/>\nof section 11 (1) (iv) of the Gujarat Agricultural Produce Market<br \/>\nAct, 1963  [&#8220;the Act&#8221; for short].\n<\/p>\n<p>4.\t\tThe<br \/>\nmunicipality passed a resolution nominating another councillor. On<br \/>\nthe basis of said resolution of the municipality, the State<br \/>\nGovernment issued the impugned notification dated 23.6.2008<br \/>\nnominating the other councillor on  APMC, Idar. The petitioner<br \/>\nchallenged the said notification by moving a petition before the<br \/>\nlearned single Judge. That petition came to be rejected. Hence, this<br \/>\nappeal.\n<\/p>\n<p>5.\t\tThe<br \/>\npetitioner&#8217;s submission before the learned single Judge, which is<br \/>\nalso reiterated before us, was that the term of Idar Municipality was<br \/>\nto come to an end on 11.3.2008 and, before that, new body was elected<br \/>\nin its meeting held on 05.3.2008; hence there was no interruption in<br \/>\nthe petitioner&#8217;s holding the office of councillor of Idar<br \/>\nMunicipality. Learned single Judge rejected that contention by<br \/>\nholding that, in the eye of law, there existed two different bodies<br \/>\nat two different times and, therefore, the nomination made by the<br \/>\nmunicipality, whose term expired on 11.3.2008, would not continue<br \/>\nafter the new body came into existence on 05.3.2008. Learned single<br \/>\nJudge also relied upon the decision of Division Bench of this Court<br \/>\nin <a href=\"\/doc\/1762431\/\">Agricultural Produce Market Committee, Unjha v. Patel<br \/>\nJayantilal Purshottamdas &amp; others<\/a> reported in 2002 (1) GLR 924,<br \/>\nwherein the following observations were made:\n<\/p>\n<p>&#8220;10.\tAs the facts stated<br \/>\nabove, the appellant was nominated by the erstwhile Municipal Council<br \/>\nwhose term expired and thereupon, the appellant&#8217;s status as a<br \/>\ncouncillor ceased. An Administrator was thereafter appointed and in<br \/>\nthe fresh election, the appellant has been re-elected, but as an<br \/>\neffect of sec.14 (1)(iii), on expiry of the term of erstwhile<br \/>\ncouncil, the appellant&#8217;s status as a Municipal Councillor ceased. As<br \/>\nan effect of sec.14 (1) (iii), his nomination qua councillor ceased.<br \/>\nHis re-election would not revive his nomination. The newly elected<br \/>\nMunicipal Council has not sent him as a nominee to the Market<br \/>\nCommittee. The proviso to sec. 11 (1) (iv) very clearly provides that<br \/>\non the appointment of Administrator, all elected members shall vacate<br \/>\ntheir office&#8230;.&#8221;\n<\/p>\n<p>6.\t\tMr.B.C.Dave, learned counsel for the appellant,<br \/>\nsubmits that, in the said decision, an Administrator was appointed so<br \/>\nas to interrupt continuity of that petitioner holding the office of<br \/>\ncouncillor of municipality. But, in the instant case, no<br \/>\nAdministrator was ever appointed and the petitioner throughout<br \/>\ncontinued to be a councillor.  Mr.Dave also submits that, under<br \/>\nsection 11 (4) (a), the term of office of a market committee shall be<br \/>\nfour years from the date of its first general meeting and, therefore<br \/>\nalso, the petitioner is entitled to continue to be a member of APMC<br \/>\nfor four years.\n<\/p>\n<p>7.\t\tSection 11 (1) (iv) of the Act provides that,  every<br \/>\nmarket committee shall consist of, inter alia, one member to<br \/>\nbe nominated by the local authority within whose jurisdiction the<br \/>\nprincipal market yard is situated, from amongst its councillors, who<br \/>\ndo not hold any general licence.  Section (1) (iii) provides that, a<br \/>\nnominated member shall cease to hold office of APMC as such member,<br \/>\nif  he being a member nominated by a local authority, ceases to be a<br \/>\ncouncillor of the local authority. We are in agreement with the view<br \/>\ntaken by the learned single Judge that, once the term of the<br \/>\nmunicipality came to an end upon newly elected body holding the<br \/>\nmeeting on 05.3.2008, the petitioner ceased to be a member nominated<br \/>\nby Idar Municipality.\n<\/p>\n<p>8.\t\tIn any view of the matter, the petitioner was<br \/>\nnominated by Idar Municipality. As per the provisions of  section 16<br \/>\nof the Bombay General Clauses Act, 1904,  the authority having powers<br \/>\nto make  the appointment shall also have power to suspend or dismiss.<br \/>\n Similarly, as per section 16 of the General Clauses Act, 1897, power<br \/>\nto appoint includes  power to terminate. The petitioner having been<br \/>\nnominated by the municipality as its representative from APMC, Idar,<br \/>\nthe municipality had full power to nominate another councillor in<br \/>\nplace of the petitioner. Therefore also, the petitioner has no right<br \/>\nto continue to be a member of APMC, Idar by virtue of his being a<br \/>\ncouncillor who was previously nominated in March, 2007.\n<\/p>\n<p>9.\t\tLearned counsel Mr.Dave&#8217;s contention was also that,<br \/>\nunder sub-section (2) of section 14 of the Act, it is only the<br \/>\nDirector of Agricultural Produce Market Committee who has the<br \/>\njurisdiction to determine whether any member ceases to hold office<br \/>\nunder sub-section (1) of section 14.  In view of the above reasoning<br \/>\nthat municipality has power to nominate its representative on the<br \/>\nAPMC and that such power to nominate also includes power to change<br \/>\nthe representative, we do not find it necessary to examine the<br \/>\nsubmission  of Mr.Dave for the appellant.\n<\/p>\n<p>10.\t\tIn view of the above discussion, we see no merit in<br \/>\nthe appeal.
