Justice J.M.JAMES\n\n Dated :20\/07\/2006\n\n O R D E R\n                         J.M.JAMES, J.\n                           --------------\n                        B.A. 4345\/2006\n                         ------------------\n      DATED THIS THE 20TH DAY OF JULY, 2006\n\n\n                           O R D E R\n<\/pre>\n<p>            The petitioner is the accused in C.R.No.23\/2002<\/p>\n<p>of Tirur Excise Range.  He was found in illegal possession<\/p>\n<p>of 1060 liters of wash, on 26.11.2002.  But he could not be<\/p>\n<p>arrested,   as   he   escaped   from   the   place   of   occurrence,<\/p>\n<p>when the Excise party came to the scene of occurrence.<\/p>\n<p>The   learned   Public   prosecutor   submitted   that   the<\/p>\n<p>petitioner had  been absconding  thereafter,  and he  could<\/p>\n<p>not be arrested.  The name of the person had been finding<\/p>\n<p>place in the records, that had been prepared by the Excise<\/p>\n<p>authorities.\n<\/p>\n<p>      2.    The   learned   Prosecutor   had   brought   to   my<\/p>\n<p>notice,  that the investigation is complete and final report<\/p>\n<p>had been filed. Because of the continuous absconding of<\/p>\n<p>the accused, the case is included in the L.P.register and a<\/p>\n<p>non bailable warrant was issued.   It is at this stage, the<\/p>\n<p>petitioner is before this Court, under Section 438 Cr.P.C.<\/p>\n<p>B.A.4345\/2006<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>        3.    In   the   above   facts   situation,   I   direct   the<\/p>\n<p>petitioner to surrender before the Judicial Magistrate of<\/p>\n<p>First Class, Tirur, on 27.7.2006 at 11.00 a.m., and move<\/p>\n<p>an   application   for   bail,   in   which   event   the   learned<\/p>\n<p>Magistrate shall go through the records, hear both sides<\/p>\n<p>and pass appropriate orders, as per the law.
