Re. LPA No. 1301\/1995 with IA No.1002\/1997.\n<\/p>\n<p>                              Interlocutory Application No. 1002\/1997 is filed<br \/>\n                   under Section 5 of the Limitation Act for condonation of<br \/>\n                   delay of 32 days occurred in filing the Letters Patent<br \/>\n                   Appeal.\n<\/p>\n<p>                              Be it noted that the Letters Patent Appeal arises<br \/>\n                   from the judgment and order dated 12th July 1995 made by<br \/>\n                   the learned single Judge in CWJC No. 10932 of 1994. The<br \/>\n                   petitioners &#8211; workmen sought to challenge the decision of<br \/>\n                   the appropriate Government not to refer the industrial<br \/>\n                   dispute raised by the Union. The learned single Judge has<br \/>\n                   observed that pending the conciliation proceedings, the<br \/>\n                   Union and the Industry had arrived at a settlement. In<br \/>\n                   view of the said settlement, the question of referring the<br \/>\n                   industrial dispute did not arise. The learned single Judge<br \/>\n                   also observed, &#8220;It may be stated that the petitioners<br \/>\n                   have completely suppressed the aforementioned facts<br \/>\n                   and, therefore, the writ petition is fit to be dismissed<br \/>\n                   for suppression of material facts as well&#8221;.\n<\/p>\n<p>                              Learned Advocate Mr Prabhat Kumar Verma<br \/>\n                   has appeared for the appellants. He has submitted that the<br \/>\n                   Union had lodged a Charter of Demands and dismissal of<br \/>\n                   six workmen was one of them. Although other issues were<br \/>\n                   settled, the question of dismissal of six workmen was not<br \/>\n                   settled.\n<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><\/p>\n<p>                   Copy of the settlement produced on the record<br \/>\n        suggests that it was a settlement in respect of the Charter<br \/>\n        of Demands submitted by the Union. Dismissal of six<br \/>\n        workmen on disciplinary grounds was also one of the<br \/>\n        demands. Thus, prima facie, it appears that the settlement<br \/>\n        was a comprehensive settlement in respect of the<br \/>\n        demands; may be that some demands may not have been<br \/>\n        accepted by the employer. Moreover, the aforesaid<br \/>\n        settlement has not been challenged by any party.\n<\/p>\n<p>                   We have also noted that though the Appeal has<br \/>\n        been filed in the year 1995, the application under Section 5<br \/>\n        of the Limitation Act was not filed for another two years<br \/>\n        until 1997. After the application under Section 5 of the<br \/>\n        Limitation Act, the same has not been pursued till today,<br \/>\n        i.e., for 13 years.\n<\/p>\n<p>                   In our opinion, the matter at dispute has now<br \/>\n        become stale inasmuch as the subject matter of challenge<br \/>\n        is the dismissal of the workmen on 30th March 1985. In all<br \/>\n        probability, the workmen have reached the age of<br \/>\n        superannuation or are nearing the age of superannuation.\n<\/p>\n<p>                   For the aforesaid reasons, the Limitation<br \/>\n        Application is rejected.\n<\/p>\n<p>                   The Letters Patent Appeal stands disposed of.<\/p>\n<pre>\n\n                                   ( R.
