To<br \/>\nsafeguard the interest of both the parties and to work out the<br \/>\nequities, we deem it fit and proper to give the following directions,<br \/>\nnamely :-\n<\/p>\n<p>1.\tCharity Commissioner or his<br \/>\ndelegate shall supervise and look after the overall working of the<br \/>\nappellant no. 1 Trust;\n<\/p>\n<p>2.\tExcept for carrying on day to<br \/>\nday affairs of the Trust, respondents herein will not be allowed to<br \/>\nmake any policy decision nor will be permitted to make any fresh<br \/>\nappointments except those who are already working;\n<\/p>\n<p>3.\tAs far as financial<br \/>\nrequirement is concerned except for day to day requirement of the<br \/>\nfinance, nothing more than that would be permitted to be withdrawn by<br \/>\nthe respondents, unless a written permission is sought from the<br \/>\nCharity Commissioner;\n<\/p>\n<p>4.\tNeedless to say, the accounts<br \/>\nfor the said period during which the respondents would be managing<br \/>\nthe affairs of the appellant no.1 Trust would be furnished to the<br \/>\nCharity Commissioner.  Even otherwise, Charity Commissioner would be<br \/>\nat liberty to look into the accounts of the appellant no.1 at any<br \/>\npoint of time, without giving any notice to them.\n<\/p>\n<p>In our considered opinion, the<br \/>\naforesaid directions would sufficiently safeguard the interests of<br \/>\nboth the parties, at least till the pendency of the Appeal.\n<\/p>\n<p>\tEven though the learned single<br \/>\nJudge has directed that the appeal preferred by respondents herein<br \/>\nand pending before Additional City Sessions Judge be considered and<br \/>\ndisposed of within a period of six months, i.e. by or before<br \/>\n5.10.2010, but looking to the urgency involved, we direct the<br \/>\nAppellate authority to consider and dispose of the said appeal on<br \/>\nmerits, in accordance with law, after giving opportunity of months<br \/>\nhereof.  We, however, clarify that while considering the appeal on<br \/>\nmerits, it would not be influenced in any manner whatsoever by any of<br \/>\nthe orders passed by the High Court or by this Court.  In view of<br \/>\nthis, the matter pending before High Court also stands disposed of.\n<\/p>\n<p>\tWith the aforesaid directions,<br \/>\nthis appeal stands disposed of, but no order as to costs.\n<\/p>\n<p>\tThe<br \/>\noriginal applicant is represented and other parties have accepted the<br \/>\nsame.  Therefore, the order of the Apex Court will not adversely<br \/>\naffect the parties.
