SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 19\/10\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>1.\tBoth<br \/>\nthese Letters Patent Appeals arise out of the judgment and order<br \/>\ndated 12.06.2001 passed by the learned Single Judge in Special Civil<br \/>\nApplication No.2327\/1989.\n<\/p>\n<p>2.<br \/>\n\tThe appellant herein was removed from service by the<br \/>\nrespondent-Corporation by order dated 15.12.1986, which was<br \/>\nchallenged by way of filing the captioned writ petition. The learned<br \/>\nSingle Judge allowed the writ petition filed by the appellant,<br \/>\noriginal petitioner, mainly on the ground that the impugned order of<br \/>\nremoval from service was passed without giving adequate opportunity<br \/>\nto the appellant to defend his case and accordingly, the appellant<br \/>\nwas ordered to be reinstated in service. The impugned order of<br \/>\nremoval was not a simpliciter order of termination but, it was passed<br \/>\non the ground of alleged misconduct on the part of the appellant. The<br \/>\nimpugned order was not passed on the ground of unsatisfactory work on<br \/>\nthe part of the appellant. In such circumstance, it was incumbent<br \/>\nupon the respondent-Corporation to hold regular departmental inquiry<br \/>\nand the appellant was required to be given adequate opportunity to<br \/>\ndefend his case. However, the same was not provided and therefore,<br \/>\nthe learned Single Judge rightly held the impugned order of removal<br \/>\nfrom service to be illegal and bad in law.\n<\/p>\n<p>3.\tHowever,<br \/>\nsince the appellant was found to be negligent in performing the<br \/>\nduties, by remaining absent unauthorizedly, no back-wages was<br \/>\nawarded. Considering the facts of the case, we are of the view that<br \/>\nthe learned Single Judge has rightly ordered reinstatement of the<br \/>\nappellant in service without any back-wages. We are in complete<br \/>\nagreement with the order passed by the learned Single Judge and<br \/>\nhence, find no reasons to entertain both these appeals.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, both the appeals are rejected.\n<\/p>\n<p>[V.M.\n<\/p>\n<p>SAHAI, J.]\t<\/p>\n<p>[K.\n<\/p>\n<p>S.
