DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Counsels for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition is directed against the order of detention dated 07.12.2010<br \/>\n\tpassed by the respondent<br \/>\n\tNo.2 in exercise<br \/>\n\tof powers conferred under Section 3(2) of the Gujarat Prevention of<br \/>\n\tAnti Social Activities Act, 1985 (for short &#8220;the Act&#8221;)<br \/>\n\tby detaining the detenue as a &#8220;bootlegger&#8221; as defined<br \/>\n\tunder Section 2(b) of the Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the detenue submits that order of detention impugned in<br \/>\n\tthis petition deserves to be quashed and set aside on the ground<br \/>\n\tthat the two incidents<br \/>\n\talleged against the detenu are not of such a magnitude and intensity<br \/>\n\tas to have the effect of disturbing the public order so as to pass<br \/>\n\tan order under Section 3(1) of the PASA Act. She has further<br \/>\n\tsubmitted that the detaining authority has not applied his mind to<br \/>\n\tthe vital facts and there was non-application of mind before<br \/>\n\trecording the order of detention. In support of the above<br \/>\n\tcontention, the learned counsel has relied upon the following<br \/>\n\tcase-laws:\n<\/p>\n<p>Judgment<br \/>\n\tand order dated 22.8.2000 of the Division Bench of this Court<br \/>\n\t(Coram: M.R. Calla &amp; R.R. Tripathi, JJ.), in Letters Patent<br \/>\n\tAppeal No.223 of 2000 in Special Civil Application No.554 of 2000<br \/>\n\t<a href=\"\/doc\/1069201\/\">(Ashok Balabhai Makwana vs. State of Gujarat)<\/a>;\n<\/p>\n<p><a href=\"\/doc\/1169973\/\">Piyush<br \/>\n\tKantilal Mehta vs. Commissioner of Police, AIR<\/a> 1989 Supreme Court<br \/>\n<span class=\"hidden_text\">\t491<\/span><\/p>\n<p><a href=\"\/doc\/195612027\/\">Om<br \/>\n\tPrakash vs. Commissioner of Police and others<\/a>, JT 1989 (4) SC 177<br \/>\n\tand<\/p>\n<p>Kanuji<br \/>\n\tS. Zala vs. state of Gujarat and others, 1999 (2) GLH 415.\n<\/p>\n<p>Learned<br \/>\n\tAGP for the respondent-State supported the detention order passed by<br \/>\n\tthe authority and submitted that sufficient material and evidence<br \/>\n\twas found during the course of investigation, which was also<br \/>\n\tsupplied to the detenue, indicating that the detenue is in the habit<br \/>\n\tof indulging into activities as defined under Section 2(b) of the<br \/>\n\tAct and, considering the facts of the case, the detaining authority<br \/>\n\thas rightly passed the order of detention and the detention order<br \/>\n\tdeserves to be upheld by this Court.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and considering the facts and<br \/>\n\tcircumstances of the case, it appears that the subjective<br \/>\n\tsatisfaction arrived at by the detaining authority cannot be said to<br \/>\n\tbe legal, valid and in accordance with law inasmuch as the offences<br \/>\n\talleged in the two FIRs cannot have any bearing on the public order<br \/>\n\tsince the law of the land i.e. Indian Penal Code and other relevant<br \/>\n\tpenal laws are sufficient enough to take care of the situation and<br \/>\n\tthat the allegations as have been levelled against the detenue<br \/>\n\tcannot be said to be germane for the purpose of bringing the detenue<br \/>\n\twithin the meaning of Section 2(b) of the Act unless and until the<br \/>\n\tmaterial is there to make out a case that the person concerned has<br \/>\n\tbecome a threat and a menace to the society so as to disturb the<br \/>\n\twhole tempo of the society and that the whole social apparatus is in<br \/>\n\tperil disturbing the public order at the instance of such person.<br \/>\n\tIn view of the ratio laid down by the Hon&#8217;ble Supreme Court in the<br \/>\n\tdecisions cited by the learned counsel for the petitioner,<br \/>\n\tthe Court is of the opinion that the activities of the detenue<br \/>\n\tcannot be said to be dangerous to the maintenance of the public<br \/>\n\torder and at the most fall under the maintenance of &#8220;law and<br \/>\n\torder&#8221;.\n<\/p>\n<p>In<br \/>\n\tthe result, this Special Civil Application is allowed. The impugned<br \/>\n\torder of detention dated 07.12.2010 passed by the respondent<br \/>\n\tNo.2 is hereby quashed and set aside.  The detenue is ordered<br \/>\n\tto be set at liberty forthwith if not required in any other case.<br \/>\n\tRule is made absolute accordingly.
