        The  writ   petition   is  filed   by   the<\/p>\n
plaintiff in O.S 51\/2003 pending on the file     of<\/p>\n
First Additional District Court, Ernakulam.     The<\/p>\n
suit has been filed in a representative capacity by<\/p>\n
the plaintiffs after getting permission from the<\/p>\n
court under Order 1 Rule 8 of Code of Civil<\/p>\n
Procedure.   The disputes involved in the suit<\/p>\n
pertain to a church over which rival claims are<\/p>\n
made  by  two  factions,  known  as  Jacobite   and<\/p>\n
Orthodox.  After the entire evidence was recorded<\/p>\n
in the case, the plaintiff moved for withdrawal of<\/p>\n
the suit seeking permission to file a fresh suit.<\/p>\n
Ext.P1 is the copy of that application.      Taking<\/p>\n
note that the suit was instituted after getting<\/p>\n
permission under Order 1 Rule 8 of Code of Civil<\/p>\n
Procedure, as contemplated by the Rule, the court<\/p>\n
W.P.(C).No.11401 OF 2009     2<\/span><\/p>\n
directed    the    plaintiff  to  give  notice  of  the<\/p>\n
withdrawal      by    publication.  Pursuant  to   such<\/p>\n
publication the respondents 9 and 10 in the present<\/p>\n
petition     appeared     and  sought  permission   for<\/p>\n
substituting them in the place of the plaintiffs<\/p>\n
and to continue prosecution of the suit.            The<\/p>\n
petitioners\/plaintiffs         objected     to     such<\/p>\n
substitution contending that the persons who are<\/p>\n
seeking    substitution belong to the rival faction,<\/p>\n
of   the   contesting    defendants.    The  contesting<\/p>\n
defendants also filed a counter affidavit opposing<\/p>\n
the withdrawal of the suit. Both these petitions,<\/p>\n
the   application      moved  by   the plaintiffs   for<\/p>\n
withdrawal, and also the other moved by the persons<\/p>\n
who   sought     for   substitution  in the   place  of<\/p>\n
plaintiffs, were jointly considered by the learned<\/p>\n
District Judge and a common order was passed.<\/p>\n
Ext.P6 is the copy of that order.       The petitioners<\/p>\n
who sought substitution were permitted to proceed<\/p>\n
with    the   case    from  the   state on   which  the<\/p>\n
plaintiffs moved for its withdrawal.        However the<\/p>\n

request of those petitioners for their substitution<\/p>\n
in   the   place     of  plaintiffs  striking  out  the<\/p>\n
plaintiffs     from    the  party  array  was  rejected.<\/p>\n
Propriety     and    correctness   of   that  order   is<\/p>\n
challenged      by     the   plaintiffs   invoking  the<\/p>\n
supervisory jurisdiction vested with this court<\/p>\n
under Article 227 of the Constitution of India.<\/p>\n
     2.    I heard the counsel on both sides.       From<\/p>\n
the facts and circumstances presented and also the<\/p>\n
submissions made by the learned counsel on both<\/p>\n
sides   with    reference    to  Ext.P6  order  and the<\/p>\n
materials tendered with the writ petition,       I find<\/p>\n
Ext.P6 order cannot be sustained for more than one<\/p>\n
reason.     If Ext.P6 order is allowed to stand then<\/p>\n
plaintiffs would continue as such in the suit, but<\/p>\n
with two more strangers as additional plaintiffs<\/p>\n
along   with    them,    the  persons  who  applied for<\/p>\n
substitution     as    plaintiffs in   the  suit.   The<\/p>\n
persons who sought for substitution are granted<\/p>\n
permission     to   prosecute   the  suit  keeping   the<\/p>\n

original plaintiffs in the party array as such,<\/p>\n
andboth    now continue with conflicting interests as<\/p>\n
masters of the suit.        In a case where a suit is<\/p>\n
filed in a representative capacity and      permission<\/p>\n
is   accorded     to   proceed with  the  claim  in  a<\/p>\n
representative capacity, but, later the court finds<\/p>\n
that    the   persons    who  had  been  granted  such<\/p>\n
permission do not prosecute the suit with due<\/p>\n
diligence it may substitute in their place some<\/p>\n
other having the same interest in the suit.       Such<\/p>\n
substitution is covered by Clause (5) of Rule 8<\/p>\n
Order (1) of the         Code of Civil Procedure.  So,<\/p>\n
the first question that emerges for consideration<\/p>\n
is when such substitution invoking the above rule<\/p>\n
is sought for by a person and a challenge is made<\/p>\n
by the plaintiffs that the party seeking such<\/p>\n
substitution is not having identical interest in<\/p>\n
the suit the       court is expected and duty bound to<\/p>\n
conduct an enquiry over that matter.     Plaintiffs in<\/p>\n
their counter affidavit specifically contended that<\/p>\n
the persons who sought for substitution belong to a<\/p>\n

different church and they are not the followers of<\/p>\n
their faction.         Whatever be the merit of such<\/p>\n
contention, once such a challenge is raised a<\/p>\n
preliminary finding that they have an identity of<\/p>\n
interest in the cause shown by the plaintiff in the<\/p>\n
suit is imperative before passing any order of<\/p>\n
substitution.       If at all any substitution is made,<\/p>\n
then also, the plaintiffs should have been removed<\/p>\n
from the party array when some other person is<\/p>\n
allowed to represent the faction which have filed<\/p>\n
the suit for the reliefs claimed thereunder; that<\/p>\n
was also not followed in the present case.         The<\/p>\n
learned    counsel     for  the contesting   defendants<\/p>\n
urged before me that the withdrawal of the petition<\/p>\n
does not satisfy the mandatory requirements covered<\/p>\n
by Order 23 Rule 1 of Code of Civil Procedure in<\/p>\n
the sense that the plaintiffs have no case that<\/p>\n
suit is bound to file on account of any formal<\/p>\n
defect or for any other sufficient cause.         I do<\/p>\n
not want to express any opinion on that point since<\/p>\n
the court below has not considered that aspect at<\/p>\n

all.   At the same time it has to be stated what is<\/p>\n
sufficient cause is an elastic expression which has<\/p>\n
to be considered in the totality of the facts and<\/p>\n
circumstances presented in the case.         The court<\/p>\n
below without adverting to any of these aspects has<\/p>\n
mechanically allowed the impleadment of additional<\/p>\n
plaintiffs to the suit rejecting the request of the<\/p>\n
plaintiffs     for   its  withdrawal Ext.P6  order   is<\/p>\n
liable to be set aside, and I do so. The court<\/p>\n
below is directed to examine afresh and dispose the<\/p>\n
petitions moved for withdrawal and the other for<\/p>\n
substitution in the light of the observations made<\/p>\n
above, and, in accordance with law.           The writ<\/p>\n
