Justice K.HEMA\n\n Dated :30\/06\/2010\n\n O R D E R\n                                K.HEMA, J.\n                             ------------------\n                        B.A. No.3707 of 2010\n                     ------------------------------------\n               Dated this the 30th day of June, 2010\n\n                               O R D E R\n<\/pre>\n<p>      This petition is for bail.\n<\/p>\n<p>     2.    The alleged offences are under Sections 341, 365,<\/p>\n<p>395 and 120(B) of Indian Penal Code. According to prosecution,<\/p>\n<p>a criminal conspiracy was hatched among accused numbers 1 to<\/p>\n<p>6 and on 03\/05\/2010 at about 2:45 p.m, petitioner (A5) along<\/p>\n<p>with five other accused travelled in a scorpio car and wrongfully<\/p>\n<p>restrained de facto complainant, who was travelling in an<\/p>\n<p>autorikshaw and assaulted him, snatched away Rs.35,000\/- and<\/p>\n<p>ATM card from him. They also withdrew Rs.50,000\/- from the<\/p>\n<p>account of de facto complainant through ATM counter causing a<\/p>\n<p>loss of Rs.85,000\/- to him.\n<\/p>\n<p>     3. Learned counsel for petitioner submitted that he<\/p>\n<p>happened to be in company of one of his friends who was<\/p>\n<p>involved in another case. Petitioner is innocent of the allegations<\/p>\n<p>made. He is in custody for the past 51 days.<\/p>\n<p>     4. This petition is not opposed. Learned Public Prosecutor<\/p>\n<p>submitted that he has no objection in granting bail but stringent<\/p>\n<p>conditions may be imposed.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No.3707 of 2010                 2<\/span><\/p>\n<p>      5. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted on conditions. Hence the following order is passed:<\/p>\n<blockquote><p>                 Petitioner shall be released on bail on his<\/p>\n<p>         executing a bond for Rs.50,000\/- with two solvent<\/p>\n<p>         sureties each for the like sum to the satisfaction of<\/p>\n<p>         the Magistrate Court concerned on the following<\/p>\n<p>         conditions:<\/p>\n<blockquote><p>               i)    Petitioner    shall    report   before   the<br \/>\n                     Investigating Officer on every Monday and<br \/>\n                     Thursday, between 10 A.M. and 1 P.M.\n<\/p><\/blockquote>\n<blockquote><p>               ii)   Petitioner shall not enter the limits of the<br \/>\n                     police station within which the crime is<br \/>\n                     registered.\n<\/p><\/blockquote>\n<blockquote><p>               iii)  Petitioner shall not influence or intimidate<br \/>\n                     any witness or tamper with the evidence.\n<\/p><\/blockquote>\n<blockquote><p>                iv)  In case, petitioner is involved in any similar<br \/>\n                     offence, bail is liable to be cancelled.\n<\/p><\/blockquote>\n<\/blockquote>\n<p>        This petition is allowed.<\/p>\n<p>                                            K.
