P. BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE P. P. BHATT)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the applicant &#8211; convict through jail<br \/>\nseeking 30 days&#8217; Temporary Bail for the purpose of medical treatment<br \/>\nof his mother.  It is stated in the application that the father of<br \/>\nthe applicant &#8211; convict has expired; his wife is not alive; he<br \/>\nhas two minor children and old age mother in the family, who is not<br \/>\nkeeping well.  In support of the application, a letter of his brother<br \/>\nin law dated 30th April 2011 is annexed, wherein, it is<br \/>\nstated that the condition of his mother is not good.\n<\/p>\n<p>2.0\tRule.\n<\/p>\n<p> Learned Additional Public Prosecutor Mr. Pandya waives service of<br \/>\nprocess of Rule.\n<\/p>\n<p>3.0\tLearned<br \/>\nAdditional Public Prosecutor invited the attention of the Court to<br \/>\nthe Jail Remarks.  The applicant &#8211; convict has enjoyed two<br \/>\nFurloughs, one in the year 2008 and another in the year 2010 and<br \/>\nevery time he reported in jail in time.  The applicant &#8211;<br \/>\nconvict has undergone imprisonment of 050 years, 05 months and 19<br \/>\ndays as on 10th May 2011.  Nothing adverse is noticed<br \/>\nagainst the convict in the Jail Remarks.\n<\/p>\n<p>4.0\tHaving<br \/>\nregard to the facts and circumstances of the case, the application is<br \/>\nallowed.  The applicant &#8211; convict is ordered to be released on<br \/>\nTemporary Bail for a period of 30 days from the date of<br \/>\nhis release, on his executing a personal bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) to the satisfaction of the jail<br \/>\nauthorities.\n<\/p>\n<p>4.1\tThe<br \/>\napplicant &#8211; convict shall surrender to the jail authorities on<br \/>\nexpiry of the Temporary Bail period.\n<\/p>\n<p>4.2\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>[<br \/>\nRavi R.
