BMTC _bus \u00b0’oeari1ji’g rcgistlration No.KA–01–F\u00bb\u00bb2369 Came<\/p>\n
  and liilegiilglent manner and dashed against<\/p>\n
  the claimant fell down and sustained<\/p>\n
ir1ju.r__ies_..-  he filed a claim petition before the<\/p>\n
 ‘ ”  .   –  l’ Bangalore, seeking compensation of<\/p>\n
A  -. The Tribunal by impugned judgment<\/p>\n
 ..and award has determined compensation of<\/p>\n
 Rs.50,200\/–, but dismissed the Claim petition on the<\/p>\n

ground that the delay in lodging the complaint to the<\/p>\n
Police and the accident is not explained.<\/p>\n

the award, both on the ground of dismissing tl\ufb01ie–,<\/p>\n

7. Learned,,  appearing for the claimant<\/p>\n
  sublnits, on {ill-“l”l+.Q_6.*when the claimant was walking on<\/p>\n
 ‘ the -Vl.ei’ti.,sidvei.AofLazar road in Frazar Town, the offending<\/p>\n
BMTC buiicame in a rash and negligent manner and<\/p>\n
dashedldagainst him, as a result, he fell down and<\/p>\n
l”l:V’_s1istained injuries. immediately he was taken to<\/p>\n
  Santosh Hospital with the help of a Police Constable<\/p>\n
Q\/..\n<\/p>\n
attached to Frazer Town Police Station and A.S.I.
\nSiddappa. He was provided treatment as out patient<\/p>\n
and sent to home. As he was suffering from fex;er4:_:and<\/p>\n
pain, he could not lodge complaint and after\u00a7V_:recoiz’e:ri1ig_T’ .<\/p>\n
from fever, he lodged the complaint  ll”<\/p>\n
Police against the driver  <\/p>\n
22-11-06. Further. helll._v’contini;ed .  as * it<\/p>\n
inpatient in Bowring, and  “Hospital from
\n29-1 1-06 to 7-12-06′. l’i:as.vcommitted an
\nerror in dismissing  the ground
\nthat   holding he failed to
\nexplaintiive.  Police and he further
\nsubmitselven compensation awarded is not<\/p>\n
just and properand-._he”diVsubmits, if the judgment and<\/p>\n
   the Tribunal are set aside and the matter is<\/p>\n
 e__remittedi,[l1e \u00abco_i,1ld examine either the traffic Police or<\/p>\n
the,1i\\.S,;E.,l:”Siddappa attached to Frazer Town Police<\/p>\n
V’~.__'”Station,V__lwho accompanied him to Santhosh Hospital<\/p>\n
  and also some independent witness to the accident.<\/p>\n
  Whereas, learned Counsel appearing for the<\/p>\n
BMTC submits he has no objection for remanding the<\/p>\n
matter, but it should be done with a condition that
\ninterest should not be awarded from the date of claim
\npetition till day.\n<\/p>\n
9. In the wound certificate — EX.P.5 issuedjby<\/p>\n
Santosh Hospital, it is stated, claimant <\/p>\n
injury in a road traffic accident  <\/p>\n
accompanied by a traffic Police  <\/p>\n
Town Police Station. In the medie’all’i*ecor:is’  <\/p>\n
to Bowring and Lady  .\u00a3jIos2pitali_””also, it is
\nmentioned, the c1ain1~a_nt_h_as;_’sustained injuries in a
\nroad traffic accident. II-scythe cerr:pl’aint’at’tached to FIR —<\/p>\n
E3X.P.iI,  ‘h:as….ex.p’iained the reasons for the
\ndelay   and Tribunal has<\/p>\n
committed ah-A.__jerror. in not Considering the same.<\/p>\n
 claimant has to establish the fact that he<\/p>\n
‘i:as..Vr’siistain(;’d’i injuries in a road traffic accident<\/p>\n
‘V occurred due to rash and negligent driving of the BMTC<\/p>\n
  examining some witness to the accident.<\/p>\n
 Therefore, it is just and proper to set aside the<\/p>\n
u “impugned judgment and award and remand the matter<\/p>\n
to the Tribunal for reconsideration. While doing so. it is
\nproper to direct the Tribunal to reconsider the matter<\/p>\n
even with regard to quantum.\n<\/p>\n
10. Accordingly, appeal is allowed. K V’<\/p>\n

remitted to the Tribunal  a direction <\/p>\n
