BASANT, J.\n             -------------------------------------------------\n                      B.A. No. 5786 OF 2007\n             -------------------------------------------------\n        Dated this the 25th day of September, 2007\n\n                                ORDER\n<\/pre>\n<p>      Application for anticipatory bail. The petitioner is the 1st<\/p>\n<p>accused, he being a husband of the de facto complainant. He<\/p>\n<p>faces allegations for offences punishable, inter alia, under<\/p>\n<p>Sec.498-A of the IPC. Investigation is now complete.              Final<\/p>\n<p>report has been filed.      The petitioner was earlier enlarged on<\/p>\n<p>bail.   The petitioner was not available for trial.            The case<\/p>\n<p>against him was split up.       The co-accused have already faced<\/p>\n<p>trial and have been acquitted, it is submitted. Coercive<\/p>\n<p>processes have been issued against the petitioner by the<\/p>\n<p>learned Magistrate.       The petitioner finds a warrant of arrest<\/p>\n<p>issued by the learned Magistrate chasing him.              The case was<\/p>\n<p>initiated as early as in 2003.\n<\/p>\n<p>      2.  According to the petitioner, he is absolutely innocent.<\/p>\n<p><span class=\"hidden_text\">B.A. No. 5786 OF 2007           -: 2 :-<\/span><\/p>\n<p>His failure to appear before the learned Magistrate was not<\/p>\n<p>wilful or deliberate. He was employed abroad and that is why he<\/p>\n<p>could not be present before the learned Magistrate.          The<\/p>\n<p>petitioner, in these circumstances, wants to surrender before the<\/p>\n<p>learned Magistrate and seek regular bail.         The petitioner<\/p>\n<p>apprehends that his application for regular bail may not be<\/p>\n<p>considered by the learned Magistrate on merits in accordance<\/p>\n<p>with law and expeditiously.    He further apprehends that before<\/p>\n<p>he surrenders before the learned Magistrate, he may be arrested<\/p>\n<p>and dragged to court in execution of the non-bailable warrant of<\/p>\n<p>arrest issued by the learned Magistrate.        It is prayed that<\/p>\n<p>directions under Sec.438 and\/or Sec.482 of the Cr.P.C. may be<\/p>\n<p>issued in favour of the petitioner.\n<\/p>\n<p>      3. The learned Public Prosecutor opposes the application.<\/p>\n<p>The petitioner has been absconding for a long period of time<\/p>\n<p>without any justification.     He may be directed to surrender<\/p>\n<p>before the learned Magistrate and seek regular bail, submits the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>      4. I have considered all the relevant inputs.     After the<\/p>\n<p>decision in Bharat Chaudhary and another v. State of Bihar<\/p>\n<p>(AIR 2003 SC 4662),       it is by now trite that powers under<\/p>\n<p><span class=\"hidden_text\">B.A. No. 5786 OF 2007           -: 3 :-<\/span><\/p>\n<p>Sec.438 of the Cr.P.C. can be invoked in favour of a person who<\/p>\n<p>apprehends arrest in execution of a non-bailable warrant issued<\/p>\n<p>by a court in a pending proceedings.           But even for that,<\/p>\n<p>sufficient and satisfactory reasons must be shown to exist. I am<\/p>\n<p>not persuaded, in the facts and circumstances of this case, that<\/p>\n<p>any such reasons exist.\n<\/p>\n<p>     5.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate    and   explain   to    the  learned   Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned    Magistrate   would    not    consider  the   petitioner&#8217;s<\/p>\n<p>application for regular bail on merits in accordance with law and<\/p>\n<p>expeditiously.    No special or specific directions appear to be<\/p>\n<p>necessary. Every court must do the same.         Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p>     4. In the result, this bail application is dismissed; but with<\/p>\n<p>the observation that if the petitioner surrenders before the<\/p>\n<p>learned Magistrate and seeks bail, after giving sufficient prior<\/p>\n<p>notice to the Prosecutor in charge of the case, the learned<\/p>\n<p><span class=\"hidden_text\">B.A. No. 5786 OF 2007          -: 4 :-<\/span><\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits<\/p>\n<p>and expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>                                                      Sd\/-\n<\/p>\n<p>                                             (R.
