Justice P.S.GOPINATHAN\n\n Dated :15\/02\/2010\n\n O R D E R\n<\/pre>\n<p>            Thottathil B.Radhakrishnan<\/p>\n<p>                         &amp;<\/p>\n<p>               P.S.Gopinathan, JJ.\n<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>               W.A.No.1204 of 2007<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>     Dated this the 15th day of February, 2010.<\/p>\n<p>                     Judgment<\/p>\n<p>  Thottathil B.Radhakrishnan, J.<\/p>\n<p>1.This appeal is by the Kerala Public Service<\/p>\n<p> Commission and its District Officer.<\/p>\n<p>2.The first respondent filed the writ petition<\/p>\n<p> claiming that he is entitled to be appointed as<\/p>\n<p> driver in the service of the second respondent<\/p>\n<p> District Co-operative Bank on the premise that on<\/p>\n<p> account of the occurrence of a vacancy in the<\/p>\n<p> cadre of drivers, the bank was bound to report<\/p>\n<p> such vacancy and the PSC was bound to advise<\/p>\n<p> accordingly.\n<\/p>\n<\/p>\n<p>3.At the stage of admission of the writ petition,<\/p>\n<p> an interim order was issued directing the bank to<\/p>\n<p><span class=\"hidden_text\">WA1204\/07             -: 2 :-<\/span><\/p>\n<p> report four vacancies. That was done. Obviously,<\/p>\n<p> that was to get over any possible situation where<\/p>\n<p> available   vacancy is     not reported during  the<\/p>\n<p> currency of a list.\n<\/p>\n<\/p>\n<p>4.However, at final hearing, it is clearly noted on<\/p>\n<p> the basis of the pleadings on record that there was<\/p>\n<p> no room for any appointment from the list that was<\/p>\n<p> in force at the time the writ petition was filed.<\/p>\n<p> However, after dismissing the writ petition, the<\/p>\n<p> learned single Judge directed that if the bank<\/p>\n<p> proposes to purchase any vehicle and if any post of<\/p>\n<p> driver arises in the bank, the writ petitioner<\/p>\n<p> shall be appointed to that post without considering<\/p>\n<p> the expiry of the rank list.\n<\/p>\n<\/p>\n<p>5.The rank list came into force with effect from<\/p>\n<p> 20.11.2002 and its validity expired on 19.11.2005.<\/p>\n<p> The judgment itself was issued only on 18.10.2006.<\/p>\n<p>6.With the aforesaid, the bank had also filed a writ<\/p>\n<p> appeal   which has  since    been withdrawn on  the<\/p>\n<p><span class=\"hidden_text\">WA1204\/07             -: 3 :-<\/span><\/p>\n<p> premise that the bank has purchased a vehicle. That<\/p>\n<p> does not, however, improve the situation in favour<\/p>\n<p> of the writ petitioner because in terms of the law,<\/p>\n<p> there could not have been any direction to appoint<\/p>\n<p> a person against a vacancy which arose after the<\/p>\n<p> rank list expired. No direction could have been<\/p>\n<p> issued to appoint &#8220;without considering the expiry<\/p>\n<p> of the rank list&#8221;. Therefore, we are of the clear<\/p>\n<p> view that the direction contained in the last<\/p>\n<p> sentence of the last paragraph of the impugned<\/p>\n<p> judgment is unsustainable. The same is liable to be<\/p>\n<p> vacated.\n<\/p>\n<p> In the result, this writ appeal is allowed vacating<\/p>\n<p> the last sentence of the last paragraph of the<\/p>\n<p> impugned judgment.
