MAHESH BHAGWATI,J.\n\n\nMr. RK Jain, for the petitioner.\nMr. Amit Punia, PP for the State.\n\n***\n<\/pre>\n<p>\t\tHeard on application filed under Section 397 of Cr.P.C with regard to the suspension of sentence.\n<\/p>\n<p>\t\tHaving heard both the parties and carefully perused the impugned order dated 14th January, 2010 rendered by Additional District &amp; Sessions judge (Fast Track) No.1, Ajmer, it is noticed that the learned Appellate Court dismissed the appeal and maintained the conviction as also sentence imposed upon the accused revisionist by the learned trial Court. The accused revisionist is found to have been convicted in the offence under Section 7\/16 of Prevention of Food Adulteration Act and sentenced to simple imprisonment for six months, together with a fine of Rs.500\/-; in default of payment of fine to suffer further simple imprisonment for one month. This conviction and sentence imposed upon the revisionist has been maintained by the learned appellate Court.\n<\/p>\n<p>\t\tThe learned counsel for the revisionist  has submitted that the accused was on bail through out the trial of the case, remained on bail during pendency of the<br \/>\n<span class=\"hidden_text\">-2-<\/span><br \/>\nappeal. Hence in view of the situation, the execution of the sentence imposed upon him by the learned appellate Court is ordered to be suspended provided the accused revisionist furnishes a personal bond in the sum of Rs. 20,000\/- together with two surety bonds each of Rs.10,000\/- to the satisfaction of the learned trial Court with the stipulation that he shall appear before this Court on 26.2.2010 and as and when called upon to do so during pendency of the revision petition.\n<\/p>\n<p>(MAHESH BHAGWATI)J.\n<\/p>\n<p>Pc<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court Kishna vs State Of Rajasthan on 25 January, 2010 S.B.Cr.
