No.3125 of 2008\n                      -------------------------------------\n              Dated this the 29th day of August, 2008\n\n                                  ORDER\n<\/pre>\n<p>      Petitioner faces indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under Sections 120 B and 471 I.P.C as also<\/p>\n<p>Section 13 of the Prevention of Corruption Act. The petitioner is<\/p>\n<p>not a public servant.       He is alleged to have entered into a<\/p>\n<p>criminal conspiracy with the co-accused, who include public<\/p>\n<p>servants, for the commission of the crime. The petitioner was<\/p>\n<p>arrested and enlarged on bail. Investigation is complete. Final<\/p>\n<p>report has already been filed and C.C.No.1 of 2008 has been<\/p>\n<p>registered against the petitioner and the other accused.<\/p>\n<p>      2.    In the course of investigation, passport of the<\/p>\n<p>petitioner was seized by the C.B.I. It is submitted that the said<\/p>\n<p>passport is not seized as a document necessary for the proof of<\/p>\n<p>the offence alleged in the case. It is also not disputed that the<\/p>\n<p>passport is not surrendered as a condition for grant of bail.<\/p>\n<p>When the petitioner was arrested, his passport was seized also.<\/p>\n<p>That is all. The petitioner had earlier requested the court to<\/p>\n<p>release the passport to him and the learned Special Judge had<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.3125 of 2008         2<\/span><\/p>\n<p>once earlier directed release of the passport to the petitioner on<\/p>\n<p>condition that he deposits an amount of Rs.1 lakh as security.<\/p>\n<p>The passport was returned to the court and the amount of Rs.1<\/p>\n<p>lakh was taken back by the petitioner.          According to the<\/p>\n<p>petitioner, he now needs his passport to travel abroad in<\/p>\n<p>connection with his employment. He made an application before<\/p>\n<p>the learned Special Judge and the learned Special Judge, by the<\/p>\n<p>impugned order, directed release of the passport again on the<\/p>\n<p>identical condition that the petitioner must deposit an amount of<\/p>\n<p>Rs.1 lakh and the same must be retained in custody of the court<\/p>\n<p>as cash security till the passport is surrendered back.<\/p>\n<p>      3.   The petitioner claims to be aggrieved by this<\/p>\n<p>direction. He submits that the passport is not a document to be<\/p>\n<p>introduced in evidence of the case.        It was not surrendered<\/p>\n<p>before court as a condition for grant of bail.          In these<\/p>\n<p>circumstances, insistence on imposition of such a condition is<\/p>\n<p>unnecessary, unreasonable and harsh. The petitioner is not now<\/p>\n<p>able to raise the amount of Rs.1 lakh to be kept with the court as<\/p>\n<p>security. In these circumstances, the said onerous condition may<\/p>\n<p>be deleted, it is prayed.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.3125 of 2008        3<\/span><\/p>\n<p>     4.    The learned Standing Counsel for the C.B.I opposes<\/p>\n<p>the prayer of the petitioner.    The learned Standing Counsel<\/p>\n<p>submits that there is very real chance of the petitioner fleeing<\/p>\n<p>from justice. At the time of grant of bail, no condition relating to<\/p>\n<p>the surrender of the passport was necessary as the passport had<\/p>\n<p>already been seized and was available before court. The learned<\/p>\n<p>Standing Counsel further submits that the petitioner is a person<\/p>\n<p>who was employed by an employer at Bombay and that there is<\/p>\n<p>nothing to show that he has to go abroad now. The learned<\/p>\n<p>Standing Counsel submits that the present submission, that the<\/p>\n<p>passport is required for him to travel abroad in connection with<\/p>\n<p>his employment under his employer at Bombay, cannot be<\/p>\n<p>accepted. At any rate, if this Court were pleased to modify the<\/p>\n<p>conditions imposed, appropriate safeguards may be insisted,<\/p>\n<p>submits the learned Standing Counsel.\n<\/p>\n<p>     5.    Having considered all the relevant circumstances, I<\/p>\n<p>am satisfied that there is merit in the opposition by the learned<\/p>\n<p>Public Prosecutor. I am satisfied that the release of the passport<\/p>\n<p>can be upheld. But the condition imposed can be modified to<\/p>\n<p>make it reasonable and not unduly harsh.\n<\/p>\n<p>     6.    In the result:\n<\/p>\n<p>     a)    This Crl.M.C is allowed in part;\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.3125 of 2008          4<\/span><\/p>\n<p>      b)   The condition imposed under the impugned order is<\/p>\n<p>modified. It is directed that the petitioner can take back his<\/p>\n<p>passport from the learned Special Judge on condition that the<\/p>\n<p>petitioner intimates to the Special Judge the period during which<\/p>\n<p>he requires the passport for his journey to abroad. If the learned<\/p>\n<p>Special Judge is satisfied about the request, the passport shall be<\/p>\n<p>released to the petitioner on condition that<\/p>\n<p>      i)   The petitioner shall execute a bond for Rs.2 lakhs with<\/p>\n<p>two solvent sureties each for the like sum to the satisfaction of<\/p>\n<p>the learned Special Judge;\n<\/p>\n<p>      ii)  In such bond, the petitioner shall undertake to<\/p>\n<p>produce the passport back before the learned Special Judge on a<\/p>\n<p>specified date after he performs his journey as required by him<\/p>\n<p>in connection with his employment;\n<\/p>\n<p>      c)   It is directed that, at any rate, the petitioner shall<\/p>\n<p>surrender the passport back before the learned Special Judge<\/p>\n<p>within a period of 3 months from the date on which such<\/p>\n<p>passport is released to the petitioner.\n<\/p>\n<\/p>\n<p>                                            (R.BASANT, JUDGE)<\/p>\n<p>rtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Alex Koshy vs Cbi\/Spe\/Kerala on 29 August, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Crl.MC.No. 3125 of 2008() 1.
