With reference to sub-Para 2(e) above, true       This information pertains to the society's\n       copy of the resolution of the managing            record and the information is not pertain\n       committee submitted by the society in             to this office.\n       compliance of Rule 25 (4) of the DCS Rules,\n       2007 for enrolment of Shri Sukhdev Ambani\n       (membership No. 2494) and the date of\n       receipt of same and the diary number as per\n       the mail receipt register of AR(NW).\n\nGrounds for First Appeal:\nAppellant sought information regarding Para 2 to 10.\nThe SPIO of deliberately violating the provisions of sec 7(1) of RTI Act, 2005 and denying the\ninformation which ought to be available in his office be forthwith brought to the notice of the RCS.\n\nOrder of the First Appellate Authority:\n\"The SPIO is directed to provide the information within 15 days from today.\"\n\nGrounds for Second Appeal:\nNo information had been provided by the SPIO after the order of FAA.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant: Mr. Ramchand Balani;\n<\/p>\n<p>Respondent: Mr. Ved Prakash, Public Information Officer &amp; Assistant Registrar;<br \/>\nThe PIO was supposed to provide the complete information with 15 days from the FAA&#8217;s order on<br \/>\n02\/12\/2009. The PIO has brought the information only during the hearing which is given to the<br \/>\n<span class=\"hidden_text\">                                                                                             Page 2 of 3<\/span><br \/>\n appellant before the Commission. Even now some of the information is missing. The PIO is directed to<br \/>\nprovide the information to the Appellant within 15 days of the Appellant giving the deficiencies.\n<\/p>\n<p>Decision dated 12\/02\/2010:\n<\/p>\n<p>The appeal was allowed. The PIO will give the information within 15 days after Appellant giving<br \/>\nthe deficiencies. The issue before the Commission is of not supplying the complete, required<br \/>\ninformation by the PIO within 30 days as required by the law. From the facts before the<br \/>\nCommission it was apparent that the PIO is guilty of not furnishing information within the time<br \/>\nspecified under sub-section (1) of Section 7 by not replying within 30 days, as per the requirement of<br \/>\nthe RTI Act. He had further refused to obey the orders of his superior officer, which raises a reasonable<br \/>\ndoubt that the denial of information may also be malafide. The First Appellate Authority had clearly<br \/>\nordered the information to be given. It appeared that the PIO&#8217;s actions attract the penal provisions of<br \/>\nSection 20 (1). A showcause notice was being issued to him, and he was directed to present himself<br \/>\nbefore the Commission at the above address on 25 March 2010 at 12.00 noon alongwith his written<br \/>\nsubmissions showing cause why penalty should not be imposed on him as mandated under Section 20<br \/>\n(1). He will also submit proof of having given the information to the appellant.\n<\/p>\n<p>Facts emerging during show cause hearing dated 25\/03\/2010:\n<\/p>\n<p>Appellant: Mr. R. C. Balani<br \/>\nRespondent: Mr. Ved Prakash, Asstt. Registrar (NW) &amp; the PIO, RCS;<br \/>\nMr. Ved Prakash, Asstt. Registrar (NW) &amp; the PIO, RCS has not given any reasonable cause for non-<br \/>\ncompliance of the FAA&#8217;s order dated 02\/12\/2009, in which the FAA had directed the SPIO, Mr. Ved<br \/>\nPrakash to provide the information to the Appellant within 15 days. He has further stated that after the<br \/>\norder of the Commission dated 12\/02\/2010 the Appellant never informed him personally about the<br \/>\ndeficiencies in the reply to the RTI application. However, the Appellant has stated that he had<br \/>\nsubmitted a letter dated 15\/02\/2010 describing the deficiencies in the reply in the office of RCS,<br \/>\nSansad Marg, New Delhi on 15\/02\/2010 by hand. The Appellant has also provided the copy of the said<br \/>\nletter dated 15\/02\/2010 bearing the receiving stamp of the RCS office dated 15\/02\/2010 to the<br \/>\nCommission. The PIO has not provided complete information to the Appellant till date.\n<\/p>\n<p>The PIO has not yet provided the information to the Appellant and stating that he needs help from the<br \/>\nappellant to be able to provide the information. The PIO&#8217;s excuse is sounding like a very lame excuse.<br \/>\nThe First Appellate Authority had ordered on 02\/12\/2009 that the information should be provided with<br \/>\nin 15 days i.e. by 17\/12\/2009. The FAA also clearly indentified that the PIO was to supply specific<br \/>\nreply as per record available to query- 2, 3, 4, 5, 7, 8 &amp; 9. Yet the PIO gave the reply on this on<br \/>\n11\/02\/2010. The Appellant was not happy with the information provided and was asked to give a list<br \/>\nof deficiencies which he gave to the Respondent on 15\/02\/2010. It appears that as far as deficiencies<br \/>\nare concerned there are some issues of interpretation. The Appellant would like to inspect the records.<br \/>\nThe Commission directs the PIO to facilitate an inspection of the records by the Appellant on 07 April<br \/>\n2010. The PIO will give photocopies of records which the Appellant wants free of cost upto 300 pages<br \/>\nduly attested.
