Justice ANTONY DOMINIC\n\n Dated :28\/11\/2008\n\n O R D E R\n                   ANTONY DOMINIC, J.\n                  --------------------------\n               W.P.(C) No.35119 OF 2008\n             -------------------------------------\n       Dated this the 28th day of November 2008\n\n                      J U D G M E N T\n<\/pre>\n<p>     The petitioners are last grade servants in the 4th<\/p>\n<p>respondent College. It is stated that the 4th respondent had<\/p>\n<p>terminated two last grade servants in 1992.          Ultimately,<\/p>\n<p>those employees have obtained favourable orders from the<\/p>\n<p>University Appellate Tribunal, a copy of which is Ext.P1. In<\/p>\n<p>pursuance to Ext.P1, those employees have also been<\/p>\n<p>reinstated.  Consequently, by Exts.P2 and P3 orders, the<\/p>\n<p>respondents 1 and 2 have required the 4th respondent to<\/p>\n<p>retrench   two    junior   most    last   grade      employees.<\/p>\n<p>Unfortunately, as at present, the petitioners are the junior<\/p>\n<p>most. It is by challenging Exts.P2 and P3, and praying for<\/p>\n<p>continuance in the college, the writ petition is filed.<\/p>\n<p>     2.   As already noticed, the proposal for retrenchment<\/p>\n<p>as reflected by Exts.P2 &amp; P3 arose out of the reinstatement<\/p>\n<p>W.P.(C) No.35119\/2008<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>consequent on Ext.P1. Since that order has become final,<\/p>\n<p>the concerned employees had to be reinstated and as an<\/p>\n<p>inevitable consequence, the junior most will have to be<\/p>\n<p>retrenched.
