Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/02\/2007\n\n O R D E R\n                     M.SASIDHARAN NAMBIAR,J.\n\n\n\n                    ------------------------------------------\n\n                        A.S .NO.769   OF  1997\n\n                    ------------------------------------------\n\n\n                    Dated    22nd    February   2007\n\n\n\n\n                             J U D G M E N T\n<\/pre>\n<p>              Plaintiff   in   O.S.349\/1994   on   the   file   of<\/p>\n<p>Principal   Sub   curt,   North   Paravur   is   the   appellant.\n<\/p>\n<p>Respondents     are   defendants.   Respondents     were   tenant<\/p>\n<p>of   the   building   bearing   door   No.8\/155   of   Aluva<\/p>\n<p>Municipality.   Appellant   purchased   the   rights   of<\/p>\n<p>building   from   the   previous   landlord   Rosamma   Jacob   on<\/p>\n<p>14\/7\/1992.   At   that   time   also   respondents   were   the<\/p>\n<p>building   tenants.   R.C.P.6\/91   was   filed   by   earlier<\/p>\n<p>landlord   to   evict   respondents   was   pending   when<\/p>\n<p>property was purchased by appellant. Order of eviction<\/p>\n<p>granted   by   Rent   Control   Court   was   subsequently<\/p>\n<p>confirmed   by   this   court   in   C.R.P   whereunder   time   was<\/p>\n<p>granted   to   respondents   to   surrender   vacant   possession<\/p>\n<p>of   the   building.   Suit   was   filed   by   appellant<\/p>\n<p>contending   that   respondents     agreed   to   surrender   the<\/p>\n<p>building,   at   the   time   when   appellant   purchased   the<\/p>\n<p>building   from   original   landlord   and   in   violation   of<\/p>\n<p>undertaking         respondents            continued           possession         of<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>building   and   therefore   respondents   are   liable   to   pay<\/p>\n<p>damages.         Rs.1,58,630\/-         was         claimed         as         damages.\n<\/p>\n<p>Respondents resisted the claim contending that landlord<\/p>\n<p>tried   to   evict   respondents   when   rent   Control   petition<\/p>\n<p>was pending and therefore appellant is not entitled  to<\/p>\n<p>the damages sought for. Learned Munsiff on the evidence<\/p>\n<p>dismissed   the   suit.   It   is   challenging   that     dismissal<\/p>\n<p>of     suit   this   appeal   is   filed.     In   the   appeal   damages<\/p>\n<p>claimed was reduced to Rs.50,000\/-.\n<\/p>\n<p>      2.    Learned   counsel   appearing   for   appellant   was<\/p>\n<p>heard.   Arguments   of   learned   counsel   appearing   for<\/p>\n<p>appellant   was   that   this   court   in   C.R.P   filed   by<\/p>\n<p>respondents   against   the   order   of   eviction   did   not<\/p>\n<p>consider   the   question   whether   appellant   is   entitled   to<\/p>\n<p>the   damages   and   appellant   was   persuaded     to   purchase<\/p>\n<p>the   building   on   the   undertaking   of   respondent   to<\/p>\n<p>surrender and as they did not surrender, appellants are<\/p>\n<p>entitled   to   the   damages   sought   for   and   therefore<\/p>\n<p>dismissal of the suit is unsustainable and appellant is<\/p>\n<p>entitled to the decree.\n<\/p>\n<p>      3.    On   hearing   learned   counsel   appearing   for<\/p>\n<p>appellant,   I   do   not   find   any   merit   in   the   appeal.\n<\/p>\n<p>Respondents   are   admittedly   tenants   of   the   assignor   of<\/p>\n<p>appellant.   Respondents   could   be   evicted   only   by   due<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>process   of   law.   In   fact,   when   appellant   purchased   the<\/p>\n<p>building   rent   control   proceedings     for   eviction   was<\/p>\n<p>pending.   In   such   circumstances,   without   getting   an<\/p>\n<p>order for eviction appellant could not have evicted the<\/p>\n<p>respondents.   So   also,   appellant   is   not   entitled   to<\/p>\n<p>claim   damages,     so   long   as   respondents   are   continuing<\/p>\n<p>in   lawful   possession   of   the   building   as   tenants.   Even<\/p>\n<p>though   order   of   eviction   was   subsequently   upheld   by<\/p>\n<p>Rent   Control   Appellate   Authority   as   well   as   revisional<\/p>\n<p>court,   even   when   suit   was   filed   respondents   were<\/p>\n<p>continuing   in   possession   and   C.R.P   was   dismissed   only<\/p>\n<p>thereafter.     In   such   circumstances,   learned   Sub   Judge<\/p>\n<p>rightly   found   that   appellant   is   not   entitled   to   the<\/p>\n<p>damages sought for.
