No.71 of 2009\n          ------------------------------------------------\n          Dated this the 25th day of February, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>    This   is      an       application               seeking  for<\/p>\n<p>condonation of delay of 1223 days in filing<\/p>\n<p>the  R.S.A.   Judgment             appealed            against was<\/p>\n<p>pronounced on 13\/12\/04; copy was applied for<\/p>\n<p>on 14\/12\/04; and copy of decree and judgment<\/p>\n<p>was taken delivery of on 15\/06\/05, but the<\/p>\n<p>R.S.A is filed after three and a half years on<\/p>\n<p>15\/01\/09. The reasons stated in the affidavit<\/p>\n<p>accompanying    the       C.M.       Application           is that<\/p>\n<p>though copy is taken delivery of on 15\/06\/05<\/p>\n<p>he could not collect the case bundle and<\/p>\n<p>prefer the R.S.A in time due to his financial<\/p>\n<p>stringency and ill-health and he could raise<\/p>\n<p>the  amount,    collect          the       case        bundles and<\/p>\n<p>certified copy of judgment and decree and<\/p>\n<p>entrust the same and give instructions to file<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.71 of 2009            -2-<\/span><\/p>\n<p>       the R.S.A to the counsel appearing in this<\/p>\n<p>       R.S.A only during the second week of January,<\/p>\n<p>       2009. The condonation of delay prayed for is<\/p>\n<p>       vehemently opposed by the respondents who have<\/p>\n<p>       filed counter as well.\n<\/p>\n<p>               2. If the reason stated by the appellant<\/p>\n<p>       is accepted as sufficient reason to condone<\/p>\n<p>       the delay either he or any other party in any<\/p>\n<p>       other appeal can seek for condonation of delay<\/p>\n<p>       stating such ground and file the appeal after<\/p>\n<p>       three and a half years or even a few years<\/p>\n<p>       later. The one third court fee paid in this<\/p>\n<p>       appeal is only Rs.450\/-. I am not prepared to<\/p>\n<p>       accept the grounds stated as sufficient cause<\/p>\n<p>       to condone the delay.\n<\/p>\n<p>               In     the result,  I  dismiss this  C.M.<\/p>\n<p>       Application.\n<\/p>\n<p>       R.S.A.71\/2009<\/p>\n<p>               C.M.    Application  No.50\/09 seeking for<\/p>\n<p>       condonation of delay of as much as 1223 days<\/p>\n<p><span class=\"hidden_text\">R. S. A.
