SIRI JAGAN, J.\n               - - - - - - - - - - - - - - - - - - - - - - -\n                  W.P.(C)No.25974 of 2010\n               - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 17th day of August, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioner challenges Ext.P6 order passed by the<\/p>\n<p>District Collector Thrissur, under the Kerala Minor Mineral<\/p>\n<p>Concession Rules, 1967, by which the petitioner has been<\/p>\n<p>imposed with a fine of Rs.50,000\/- allegedly for violation of<\/p>\n<p>the provisions of the Mines and Minerals (Development and<\/p>\n<p>Regulation) Act, 1957 in the matter of unauthorized<\/p>\n<p>transport of M sand. One of the contentions raised by the<\/p>\n<p>petitioner is that, the District Collector does not have<\/p>\n<p>jurisdiction to pass such an order under the Kerala Minor<\/p>\n<p>Mineral Concession Rules, 1967 or the Mines and Minerals<\/p>\n<p>(Development and Regulation) Act, 1957.<\/p>\n<p>     2.    The learned Government Pleader while admitting<\/p>\n<p>that the District Collector does not have the power to<\/p>\n<p>impose fine under the Act and Rules submits that, since<\/p>\n<p>there is actual violation of the provisions of the Act, it must<\/p>\n<p>W.P.(C)No.25974 of 2010<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>be left to the appropriate authority to proceed with the<\/p>\n<p>matter in accordance with law.\n<\/p>\n<p>      3.    Having considered the arguments on both sides, I<\/p>\n<p>dispose of this writ petition as follows:<\/p>\n<p>      Ext.P6 is quashed. The appropriate authority having<\/p>\n<p>jurisdiction to proceed further in respect of the violation<\/p>\n<p>noted in Ext.P6 is directed to proceed further in accordance<\/p>\n<p>with law.\n<\/p>\n<p>      The vehicle shall be produced before the concerned<\/p>\n<p>criminal court within a period of one week from the date of<\/p>\n<p>receipt of a certified copy of this judgment. The petitioner<\/p>\n<p>may approach the criminal court for interim custody of the<\/p>\n<p>vehicle.\n<\/p>\n<\/p>\n<p>                                              S.
