No. 335 of 2003 A\n            =-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n         Dated this the 26th day of March, 2010\n\n                         JUDGMENT\n<\/pre>\n<p>      Challenge in this appeal by the accused is to the<\/p>\n<p>judgment of the Addl. District and Sessions Judge, Fast<\/p>\n<p>Track (Adhoc-I), Kozhikode dated January 27, 2003 in S.C.<\/p>\n<p>No. 260 of 1999, convicting him under section 55(a) of the<\/p>\n<p>Abkari Act and sentencing him to undergo rigorous<\/p>\n<p>imprisonment for a period of two years and to pay fine of<\/p>\n<p>Rs.1 lakh, in default to undergo simple imprisonment for a<\/p>\n<p>further period of six months.\n<\/p>\n<p>      2. The case of the prosecution, as shaped in evidence<\/p>\n<p>before the trial court, in brief is this:-\n<\/p>\n<p>      On July 2, 1998 at about 5.30 p.m. while PW1, the<\/p>\n<p>then Sub Inspector of Police, Atholi along with PW.2 a<\/p>\n<p>Constable attached to that Police Station were on patrol<\/p>\n<p>duty at Ulliyeri Bus Stand, the accused was found holding a<\/p>\n<p>plastic cover and on search it was found to contain 7<\/p>\n<p>bottles, each having a quantity of 375 ml. of Indian Made<\/p>\n<p><span class=\"hidden_text\">Crl.A. 335\/2003                  2<\/span><\/p>\n<p>Foreign Liquor. The articles were seized in the presence of<\/p>\n<p>two independent witnesses, PWs.3 and 4. The accused was<\/p>\n<p>arrested and produced before the committal court. The case<\/p>\n<p>was investigated by PW6, the then Head Constable of that<\/p>\n<p>station. After completing the investigation, the charge was<\/p>\n<p>laid before the committal court by PW1 alleging offences<\/p>\n<p>punishable under Sec. 55(a) and 55(g) of the Abkari Act.<\/p>\n<p>         3.When the accused appeared before the committal<\/p>\n<p>court, copies of documents relied on by the prosecution<\/p>\n<p>were furnished to him. As the offence punishable under<\/p>\n<p>section 55(a) and 58 of the Abkari Act are exclusively<\/p>\n<p>triable by a Court of Sessions, the case was committed to<\/p>\n<p>the Sessions Court, Kozhikode from where it was made over<\/p>\n<p>to the trial court for trial and disposal.\n<\/p>\n<p>         4. The accused, on appearance before the trial court,<\/p>\n<p>pleaded not guilty to the charge under sections 55(a) and<\/p>\n<p>58 of the Abkari Act. On the side of the prosecution PWs.1<\/p>\n<p>to 6 were examined and Exts.P1 to P8 and MOI series and<\/p>\n<p>MOII were marked. When he was questioned under section<\/p>\n<p><span class=\"hidden_text\">Crl.A. 335\/2003                  3<\/span><\/p>\n<p>313 Cr.P.C. by the trial court, he denied the incriminating<\/p>\n<p>circumstances. No evidence was adduced on the side of the<\/p>\n<p>defence. The learned Magistrate, on an appreciation of the<\/p>\n<p>evidence, found the accused guilty under section 55(a) of<\/p>\n<p>the Abkari Act, convicted him there under and sentenced<\/p>\n<p>him as aforesaid. He was acquitted of the charge under<\/p>\n<p>section 58 of the Police Act. The accused has now come up<\/p>\n<p>in appeal challenging his conviction and sentence.<\/p>\n<p>         5. Heard the learned counsel appearing for the<\/p>\n<p>appellant and the learned Public Prosecutor.<\/p>\n<p>         6. The following points arise for consideration :-<\/p>\n<p>        1)      Whether     the     conviction    of    the<br \/>\n               appellant\/accused by the trial court under<br \/>\n               section 55(a) of the Abkari Act can be<br \/>\n               sustained?\n<\/p>\n<p>        2)     Whether the sentence imposed by the trial<br \/>\n               court is excessive or unduly harsh?\n<\/p>\n<p>         7. The case of the prosecution was that on July, 2,<\/p>\n<p>1998 at about 5.30 p.m. the accused was found to be in<\/p>\n<p>possession of 7 bottles of Indian Made Foreign Liquor, each<\/p>\n<p>containing 375 ml. near the Bus Stand at Ulliyeri and that<\/p>\n<p><span class=\"hidden_text\">Crl.A. 335\/2003               4<\/span><\/p>\n<p>thereby committed the offence punishable under section 55<\/p>\n<p>(a) of the Abkari Act. PWs.1 to 6 were examined on the side<\/p>\n<p>of the prosecution before the lower court. PW1 is the then<\/p>\n<p>S.I. of Police, Atholi Police Station who detected the<\/p>\n<p>offence. PW2 is the Constable who accompanied him. They<\/p>\n<p>gave a consistent version regarding the recovery of MOI<\/p>\n<p>series, the bottles containing I.M.F.L. and MOII the bag.<\/p>\n<p>Nothing was brought out in their cross-examination to show<\/p>\n<p>that they have any enmity towards the accused. The counsel<\/p>\n<p>for the appellant\/accused argued that as the two<\/p>\n<p>independent witnesses to the seizure mahazar turned<\/p>\n<p>hostile and did not support the prosecution and PWs.1 and<\/p>\n<p>2 being the official witnesses, their evidence should not be<\/p>\n<p>believed. I am not inclined to agree. It is settled law that<\/p>\n<p>evidence of official witness can be believed without any<\/p>\n<p>corroboration, if the same found to be reliable and<\/p>\n<p>trustworthy. The trial court found their evidence reliable<\/p>\n<p>and chosen to believe them. I have gone through their<\/p>\n<p>evidence. I find no reason to come to a different conclusion.<\/p>\n<p><span class=\"hidden_text\">Crl.A. 335\/2003               5<\/span><\/p>\n<p>Therefore, accepting their evidence I hold that the<\/p>\n<p>prosecution has succeeded in proving the recovery of MOI<\/p>\n<p>series and MOII from the accused.\n<\/p>\n<p>         8. The learned counsel for appellant\/accused relying<\/p>\n<p>on a decision of this Court reported in <a href=\"\/doc\/559544\/\">Ali V. State of Kerala<\/a><\/p>\n<p>(2001(2) KLT 389) argued that though PW1 testified that<\/p>\n<p>he prepared and sent arrest memo before arresting the<\/p>\n<p>accused, no such arrest memo is seen in the records and<\/p>\n<p>also there is delay in forwarding the seized articles to court,<\/p>\n<p>which casts serious doubt regarding the version of PWs.1<\/p>\n<p>and 2 about the arrest of the accused and alleged seizure of<\/p>\n<p>MOI series and MOII from the accused. I am unable to<\/p>\n<p>agree. Mere absence of arrest memo and delay in<\/p>\n<p>forwarding the seized articles to court is not a ground to<\/p>\n<p>discard the entire case of the prosecution. I have chosen to<\/p>\n<p>believe the evidence of PWs.1 and 2 regarding the arrest of<\/p>\n<p>the accused and seizure of MOI series and MOII from the<\/p>\n<p>accused. Further all the bottles seized were sealed from the<\/p>\n<p>spot and PWs.1, 2 and 3 have signed on the label. Those<\/p>\n<p><span class=\"hidden_text\">Crl.A. 335\/2003               6<\/span><\/p>\n<p>seals were found intact. In Ext.P5 Chemical Analyst has<\/p>\n<p>reported that the seals were intact and tallied with sample<\/p>\n<p>seals. There is nothing to show that the samples were<\/p>\n<p>tampered with. Further the report of the Chemical Analyst<\/p>\n<p>shows that MOI series contains I.M.F.L. Therefore,<\/p>\n<p>accepting the evidence of PWs.1 and 2, I hold that the<\/p>\n<p>accused was found in possession of      MOI series bottles<\/p>\n<p>containing I.M.F.L. of 1.425 litres, as alleged by the<\/p>\n<p>prosecution.\n<\/p>\n<p>         9. Next question for consideration is whether a<\/p>\n<p>charge under section 55(a) will lie against the accused. The<\/p>\n<p>counsel for the appellant argued that during 1998<\/p>\n<p>permissible quantity of I.M.F.L. a person can possess was<\/p>\n<p>4.5 litres. as provided under the Order of the Government<\/p>\n<p>S.R.O.No.225\/98 dated March 5, 1998 and that in this case<\/p>\n<p>the accused was found in possession of only 7 bottles of 375<\/p>\n<p>ml. each totalling to 1.425 litres of Indian Made Foreign<\/p>\n<p>Liquor and therefore no charge under section 55(a) of the<\/p>\n<p>Abkari Act will lie against the accused. The learned Public<\/p>\n<p><span class=\"hidden_text\">Crl.A. 335\/2003                 7<\/span><\/p>\n<p>Prosecutor would say that the seized bottles do not bear the<\/p>\n<p>security labels of Beverages Corporation as required under<\/p>\n<p>section 26 of the Abkari Act and that therefore charge<\/p>\n<p>under section 55(a) of the Abkari Act will lie against the<\/p>\n<p>accused.\n<\/p>\n<p>         10. There is force in the contention of the appellant<\/p>\n<p>that as the accused was found in possession of I.M.F.L.<\/p>\n<p>below the permissible quantity, no charge under section 55<\/p>\n<p>(a) of the Abkari Act will lie against the accused. It is seen<\/p>\n<p>seen from S.R.O. No.225\/98 dated March 5, 1998 that a<\/p>\n<p>person can possess for his own use I.M.F.L . up to 4.5 litres.<\/p>\n<p>The prosecution has failed to show that the accused has<\/p>\n<p>kept those contraband articles for sale. Therefore, I am of<\/p>\n<p>the view that a charge under section 55(a) will not lie<\/p>\n<p>against accused. That being so, the conviction of the<\/p>\n<p>accused by the trial court under section 55(a) of the Abkari<\/p>\n<p>Act cannot be sustained.\n<\/p>\n<p>         11. There is another aspect in this case. The seized<\/p>\n<p>bottles, MOI series, do not contain the security label of the<\/p>\n<p><span class=\"hidden_text\">Crl.A. 335\/2003               8<\/span><\/p>\n<p>Beverages Corporation. Therefore, the accused is guilty of<\/p>\n<p>violation of Rule 26 of the Foreign Liquor Rules, which is<\/p>\n<p>punishable under section 63 of the Abkari Act. Therefore,<\/p>\n<p>while acquitting the accused of the charge under section 55<\/p>\n<p>(a) of the Abkari Act, I convict the accused for violation of<\/p>\n<p>rule 26 of the Foreign Liquor Rules, which is punishable<\/p>\n<p>under section 63 of the Abkari Act.\n<\/p>\n<p>         12. Thus, the appellant\/accused is acquitted of the<\/p>\n<p>charge under section 55(a) of the Abkari Act, instead he is<\/p>\n<p>convicted under section 63 of the Abkari Act for violation of<\/p>\n<p>rule 26 of the Foreign Liquor Rules. He is sentenced to pay<\/p>\n<p>a fine of Rs.1,000\/-, in default to undergo simple<\/p>\n<p>imprisonment for three months under section 63 of the<\/p>\n<p>Abkari Act. One month&#8217;s time is granted for payment of the<\/p>\n<p>fine. His bail bonds are cancelled.\n<\/p>\n<\/p>\n<p>                                        P.Q.
