PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npresent application has been filed by the applicant for grant of<br \/>\nregular bail under sec. 439 of the Code of Criminal Procedure after<br \/>\nthe charge sheet is filed, which is a successive bail application<br \/>\nafter Criminal Misc. Application No. 12285 of 2010 was withdrawn.\n<\/p>\n<p>2.\tThe<br \/>\napplicant-accused is charged with having committed offences under<br \/>\nsections 406, 409, 420 and 114 of IPC for which FIR, being C.R. No.<br \/>\nI-470\/2009, has been registered with Sector-7 Police Station,<br \/>\nGandhinagar.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Rawal submitted that the applicant is not involved and<br \/>\nthe amount has not been deposited in his account and in any case as<br \/>\nnow the charge sheet has been filed and the case is based on<br \/>\ndocumentary evidence, the present application may be allowed.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Mr. Sejpal submitted that the amount meant for the scholarship<br \/>\nwas diverted and misappropriated in connivance with other co-accused<br \/>\nand the same has now been been deposited.  He submitted that there<br \/>\nare two other cases also registered against him.  Learned  advocate<br \/>\nMr. Rawal has stated that in both the other two cases he has been<br \/>\nreleased on bail. .\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Mr. Rawal and learned APP Mr. Sejpal and<br \/>\nhaving considered the nature of offence, the role attributed and also<br \/>\nconsidering the fact that the investigation is over and charge sheet<br \/>\nis filed,  the present application deserves to be allowed.\n<\/p>\n<p>6.\tThe<br \/>\napplication is accordingly allowed.  The applicant is ordered to be<br \/>\nreleased on bail in connection with C.R.<br \/>\nNo. I-470\/2009 registered with Sector-7 Police Station, Gandhinagar<br \/>\non his executing a personal bond of Rs. 5,000\/- (Rupees Five Thousand<br \/>\nonly) with one solvent surety for the like amount to the satisfaction<br \/>\nof the lower court and subject to the further conditions that he<br \/>\nshall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to<br \/>\ntry to tamper or pressurize the prosecution witnesses or complainant<br \/>\nin any manner;\n<\/p>\n<p>(c )\tnot<br \/>\nact in any manner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before the concerned Police Station on the first Monday<br \/>\nof every calendar month between 11.00 am to 2.00 pm till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the investigating officer and also to<br \/>\nthe court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower court having jurisdiction to try the case. It would<br \/>\nbe open to the trial court concerned to give time to furnish the<br \/>\nsolvency certificate, if prayed for.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute.
