He approached the Civil Court by way of filing a<\/p>\n<p>civil suit for permanent injunction against respondent Nos. 2 and 5 to<\/p>\n<p>protect the possession of the premises. The suit of the petitioner<br \/>\n Civil Writ Petition No. 7398 of 2008                           [2]<\/p>\n<p>was decreed in the following terms:\n<\/p>\n<blockquote><p>                     &#8221; &#8230;. In view of foregoing discussion, an ex parte<br \/>\n                     decree is passed in favour of the plaintiff and<br \/>\n                     against the defendants, restraining the defendants<br \/>\n                     from interfering in the peaceful possession of the<br \/>\n                     plaintiff over the disputed premises and not to<br \/>\n                     demolish one room and boundary wall measuring<br \/>\n                     covered area of 200 sq. yards, as detailed in the<br \/>\n                     head note of the plaint, forcibly or illegally except in<br \/>\n                     due course of law. The defendant Nos. 2 and 3 are,<br \/>\n                     however, free to proceed against the plaintiff in<br \/>\n                     accordance with law. There is no order as to<br \/>\n                     costs&#8230;.&#8221;<\/p><\/blockquote>\n<p>              The grievance of the petitioner in the writ petition is that<\/p>\n<p>respondent No.5, in collusion with official respondents, is harassing<\/p>\n<p>him and are trying to demolish the rented accommodation and no<\/p>\n<p>action is being taken against the said persons.<\/p>\n<p>              Written statement on behalf of respondents No. 1 to 4 has<\/p>\n<p>been filed, which is on record.\n<\/p>\n<p>              Mr.K.K.Gupta,            learned   counsel    appearing     for<\/p>\n<p>respondents No. 1 to 4,            has raised a preliminary objection that<\/p>\n<p>petitioner has encroached upon the government&#8217;s land in an<\/p>\n<p>unauthorized manner and has constructed a room and boundary wall<\/p>\n<p>over the said land. In this regard, many complaints were made by<\/p>\n<p>the aggrieved persons of the locality and the Enforcement Wing of<\/p>\n<p>Chandigarh Administration also lodged a complaint with the police<\/p>\n<p>station vide DDR No.15 dated 21.8.2007 but the petitioner has not<\/p>\n<p>removed the        illegal encroachment made          over the government&#8217;s<\/p>\n<p>land.    It has also been argued by Mr.Gupta that the civil Court,<br \/>\n Civil Writ Petition No. 7398 of 2008                              [3]<\/p>\n<p>Chandigargh, by an ex parte judgment and decree dated 2.11.2002,<\/p>\n<p>has only directed defendant Nos. 2 and 3 in the said suit not to<\/p>\n<p>dispossess the plaintiff, except in due course of law and liberty was<\/p>\n<p>also granted to defendant Nos. 2 and 3 to proceed against the<\/p>\n<p>plaintiff in accordance with law. The petitioner was asked to remove<\/p>\n<p>the   encroachment         but    the    same    has   not    been      removed.<\/p>\n<p>Subsequently, the petitioner            filed an application under Order 39,<\/p>\n<p>Rule 2-A, Civil Procedure Code, for taking action against the officials<\/p>\n<p>of the Estate Office who removed his encroachments upon the<\/p>\n<p>Government land.           The competent authority has already filed the<\/p>\n<p>reply to the said application but the petitioner is prolonging the matter<\/p>\n<p>on one pretext or the other and the matter is still pending before the<\/p>\n<p>civil Court.\n<\/p>\n<p>               We have heard the arguments of learned counsel for the<\/p>\n<p>parties and have perused the writ records.\n<\/p>\n<p>               Admittedly, the matter is        still pending before the civil<\/p>\n<p>Court and petitioner has no cause of action to file the present writ<\/p>\n<p>petition. Even otherwise also, we               have no      sympathy for the<\/p>\n<p>encroachers who have encroached upon the government&#8217;s land. The<\/p>\n<p>writ petition is merely an abuse of the process of the Court and has<\/p>\n<p>been filed without any cause of action. No relief can be granted<\/p>\n<p>under Articles 226\/227 of the Constitution of India.
