BASANT, J.\n\n               -------------------------------------------------\n\n                        CRL.M.C.NO. 659 OF 2007\n\n               -------------------------------------------------\n\n              Dated this the 14th day of March, 2007\n\n\n                                   ORDER\n<\/pre>\n<p>       The   petitioner   is   aggrieved   by   Condition   No.2   imposed<\/p>\n<p>on   him   when   a   vehicle   belonging   to   him   was   directed   to   be<\/p>\n<p>released   to   him.       The   said   vehicle   is   allegedly   involved   in<\/p>\n<p>illicit transportation of river sand.     By the said condition, the<\/p>\n<p>learned   Magistrate   directed   that   the   petitioner   must   deposit<\/p>\n<p>an   amount   of   Rs.25,000\/-   before   claiming   release   of   the<\/p>\n<p>vehicle.\n<\/p>\n<\/p>\n<p>       2.      The   learned  counsel  for the   petitioner   submits  that<\/p>\n<p>the said condition  is  absolutely  unnecessary   and  unjustified.<\/p>\n<p>The   petitioner     has   been   directed   already   to   execute   a   bond<\/p>\n<p>for     Rs.1   lakh   with     two   solvent   sureties.       That   condition<\/p>\n<p>sufficiently protects the interests of the State.   The petitioner<\/p>\n<p>is   poor   and   indigent.       He   is   unable   to   raise   the   amount   of<\/p>\n<p>Rs.25,000\/- to make cash deposit.   In these circumstances, the<\/p>\n<p>petitioner   has   been   unable   to   take   advantage   of   the   order<\/p>\n<p>dated   12\/2\/07.     The   vehicle   is   exposed   to   sun   and   rain<\/p>\n<p><span class=\"hidden_text\">CRL.M.C.NO. 659 OF 2007                 -: 2 :-<\/span><\/p>\n<p>unnecessarily.     It   is   suffering   damage   and   deterioration.     The<\/p>\n<p>learned counsel wants this Court to take note of the fact that the<\/p>\n<p>petitioner&#8217;s vehicle is even allegedly not involved earlier   in any<\/p>\n<p>other similar crime.     In support of this contention, he relies on<\/p>\n<p>the objections filed by the revenue official  to his application for<\/p>\n<p>release of the vehicle.   Admittedly, no  order has been passed by<\/p>\n<p>the   District   Collector   under   the   relevant   Rule   27   of   the<\/p>\n<p>Protection   of   River   Banks   and   Regulation   of   Removal   of   Sand<\/p>\n<p>Rules,  2002.      The  petitioner  is willing   to  undertake  to  pay  the<\/p>\n<p>amount which may be legally found to be due and payable from<\/p>\n<p>him   by   the   District   Collector   under   Rule   27   of   the   Rules.       In<\/p>\n<p>these circumstances, the unfortunate consequence of the vehicle<\/p>\n<p>deteriorating   in   custody   of   the   officials   may   be   avoided.       The<\/p>\n<p>Supreme   Court   decision   in  <a href=\"\/doc\/25703131\/\">Sunderbhai   Ambalal   Desai   v.<\/p>\n<p>State  of Gujarat  (AIR<\/a> 2003 SC 638) which reveals the anxiety<\/p>\n<p>of   the   system   to   avoid   such   unnecessary   damage   and<\/p>\n<p>deterioration of the properties involved in criminal cases is also<\/p>\n<p>brought to my notice by the learned counsel.<\/p>\n<p>       3.  Having considered all the relevant inputs, I am satisfied<\/p>\n<p>that it is not necessary to insist on imposition of the condition of<\/p>\n<p>cash   deposit   of   Rs.25,000\/-.     Condition   No.1   imposed   shall<\/p>\n<p><span class=\"hidden_text\">CRL.M.C.NO. 659 OF 2007                -: 3 :-<\/span><\/p>\n<p>adequately   take   care   of   the   situation.       The   petitioner   must,   in<\/p>\n<p>the   bond   to   be   executed,   undertake   before   the   learned<\/p>\n<p>Magistrate   that   he   shall,   subject   to   the   avenues   of   challenge<\/p>\n<p>which   are   available   to   him,   deposit   the   amount   which   may   be<\/p>\n<p>payable by him as per the order of the District Collector.     The<\/p>\n<p>bond to be executed shall secure such amount also.<\/p>\n<p>        4.    In  these  circumstances,  this  Crl.M.C.  is  allowed to  the<\/p>\n<p>above extent.   Condition No.2 shall stand deleted.    In the bond<\/p>\n<p>to be executed, the petitioner shall undertake that the amounts<\/p>\n<p>which   may   be   found   due   and   payable   in   accordance   with   law<\/p>\n<p>under  Rule  27  of the  Rules  shall  be paid by him to the  District<\/p>\n<p>Collector as and when directed.\n<\/p>\n<\/p>\n<p>        Hand  over   a  copy   of  this   order  to   the   learned  counsel   for<\/p>\n<p>the petitioner.\n<\/p>\n<\/p>\n<p>                                                                   Sd\/-\n<\/p>\n<p>\n                                                      (R.
