We have  also considered  the  Records &amp;<br \/>\nProceedings and heard the learned APP for the State.\n<\/p>\n<p>3.\t\tIt<br \/>\nappears that  the accused, in the capacity of  Police Officers, while<br \/>\ninvestigating into  an offence  registered as CR No.I-115 of 2007,<br \/>\nwere insisting for production of muddamal from the complainant.  As<br \/>\nper the evidence on record, there is no acceptance of the amount by<br \/>\nthe accused and on the contrary, the trap has also failed.  The basic<br \/>\nrequirement of demand is also not proved by spectrography for  voice<br \/>\ntesting.  Therefore, even demand is also not proved.\n<\/p>\n<p>4.\t\tIn<br \/>\nabove view of the matter, if the learned Special Judge has found that<br \/>\nthe prosecution has not been able to prove  its case beyond<br \/>\nreasonable doubt, the same cannot be said to be erroneous.  Hence,<br \/>\nthe leave to appeal does not  deserve to be granted.  Therefore,  not<br \/>\ngranted.
