               Petitioner,                 the         accused in<\/p>\n
S.T.2547\/1997 on the file of Judicial First<\/p>\n
Class  Magistrate,              Pattambi              filed   this<\/p>\n
revision  challenging               his        conviction      and<\/p>\n
sentence for the offence under Section 138<\/p>\n
of    Negotiable          Instruments                Act.   Second<\/p>\n
respondent   lodged            the        complaint,         taken<\/p>\n
cognizance    by         the         learned            Magistrate<\/p>\n
contending      that             petitioner               borrowed<\/p>\n
Rs.40,000\/- and issued Ext.P1 cheque dated<\/p>\n
7\/4\/1997 drawn in his account maintained in<\/p>\n
Palakkad District Treasury and when the<\/p>\n
cheque was presented for encashment, it was<\/p>\n
dishonoured for want of sufficient funds<\/p>\n
and second respondent sent Ext.P4 notice<\/p>\n

demanding the amount covered by the dishonoured<\/p>\n
cheque which was received by the petitioner<\/p>\n
under      Ext.P3  acknowledgment  and  petitioner<\/p>\n
failed to pay the amount and thereby committed<\/p>\n
the offence under Section 138 of        Negotiable<\/p>\n
Instruments Act.\n<\/p>\n
           2. On appearance petitioner pleaded not<\/p>\n
guilty. Second respondent was examined as PW1.<\/p>\n
Ext.P1     to   P5  were  marked.  Petitioner  was<\/p>\n
examined as DW1 and Exts.D1 and D2 were marked.<\/p>\n
Learned     Magistrate  on the evidence found that<\/p>\n
petitioner     borrowed  Rs.40,000\/-  from  second<\/p>\n
respondent and issued Ext.P1 cheque towards its<\/p>\n
repayment and Ext.P1 was dishonoured for want<\/p>\n
of sufficient funds and second respondent had<\/p>\n
complied      with   all   statutory  formalities.<\/p>\n
Petitioner     was   convicted  and  sentenced  to<\/p>\n
simple       imprisonment   for three months and<\/p>\n
compensation     of  Rs.40,000\/-  without  default<\/p>\n

sentence. Petitioner challenged the conviction<\/p>\n
and sentence before Sessions Court, Palakkad in<\/p>\n
Crl.A.204\/2001. Learned Sessions Judge on re-<\/p>\n
appreciation     of   evidence    confirmed   the<\/p>\n
conviction    and  sentence  and   dismissed  the<\/p>\n
appeal. It is challenged in the revision.<\/p>\n
           3.  Learned  counsel appearing for the<\/p>\n
petitioner was heard.\n<\/p>\n
           4. Argument of the   learned   counsel<\/p>\n
is    that   courts   below  did   not   properly<\/p>\n
appreciate the evidence and on the evidence the<\/p>\n
conviction    is   not   sustainable.     Learned<\/p>\n
counsel submitted that in any case, sentence<\/p>\n
may be modified and petitioner is prepared to<\/p>\n
pay the compensation.\n<\/p>\n
           5. Evidence of  PW1  accepted  by  the<\/p>\n
learned Magistrate     establish that petitioner<\/p>\n
borrowed Rs.40,000\/- and issued Ext.P1 cheque<\/p>\n
towards its repayment. Suggestion made by the<\/p>\n

petitioner when PW1 was cross examined was that<\/p>\n
he had borrowed Rs.10,000\/- from one Muhammed<\/p>\n
and issued a blank cheque and it was misused by<\/p>\n
the second respondent and he did not borrow any<\/p>\n
amount from the second respondent. But when<\/p>\n
petitioner was examined as DW1, his case was<\/p>\n
that he borrowed Rs.10,000\/- from Muhammed and<\/p>\n
issued a cheque for that amount based on which<\/p>\n
Muhammed    instituted  proceedings  which   had<\/p>\n
finally settled between the parties. It is his<\/p>\n
evidence    that subsequently through  a  broker<\/p>\n
petitioner entrusted a blank cheque, which was<\/p>\n
misused by the second respondent. First of all,<\/p>\n
such a case was not put to PW1 and was put<\/p>\n
forth for the first time when petitioner was<\/p>\n
examined. The   alleged broker was not examined.<\/p>\n
On the other hand, suggestion made to PW1 that<\/p>\n
he issued a blank cheque to Muhammed which was<\/p>\n
misused by the second respondent was proved to<\/p>\n

be false by evidence of DW1 himself. In such<\/p>\n
circumstances,     learned Magistrate  and learned<\/p>\n
Sessions     Judge     was  perfectly  correct  in<\/p>\n
accepting the evidence of PW1, holding that<\/p>\n
petitioner     borrowed  Rs.40,000\/-   and  issued<\/p>\n
Ext.P1 cheque towards its repayment. Evidence<\/p>\n
of PW1 established that when the amount was<\/p>\n
borrowed,     on  the  request  of the  petitioner<\/p>\n
second     respondent  filled  up the  cheque  and<\/p>\n
thereafter     petitioner  signed the  cheque  and<\/p>\n
handed it over to the second respondent. It is<\/p>\n
established     that  Ext.P1   cheque  was  issued<\/p>\n
towards discharge of the liability.<\/p>\n
           6. Though   petitioner  also  raised a<\/p>\n
contention     that   he   did  not  receive   the<\/p>\n
statutory notice, DW1 admitted that address of<\/p>\n
the petitioner shown in Ext.P4 notice is the<\/p>\n
correct address. Ext.P3 postal acknowledgment<\/p>\n
card establishes that Ext.P4 notice which was<\/p>\n

sent by registered post, was served on the<\/p>\n
addressee.      Though   petitioner    raised    a<\/p>\n
contention that signature seen in the postal<\/p>\n
acknowledgment card is not his address, he did<\/p>\n
not examine the postman and did not adduce any<\/p>\n
evidence, except his interested version. Though<\/p>\n
Ext.D1 attendance register      show that he had<\/p>\n
attended all the working days in that month,<\/p>\n
where he is working as a Peon, it does not<\/p>\n
establish     that  petitioner  did  not   receive<\/p>\n
Ext.P4     notice.   Learned    Magistrate    and<\/p>\n
learned Sessions Judge    was perfectly justified<\/p>\n
in finding that second respondent had complied<\/p>\n
with all the statutory formalities including<\/p>\n
demanding the amount covered by the dishonoured<\/p>\n
cheque in writing. Conviction of the petitioner<\/p>\n
for     the   offence   under   Section   138   of<\/p>\n
Negotiable Instruments Act    is perfectly legal.<\/p>\n
           7. Then the only question is regarding<\/p>\n
CRRP 322\/04               7<\/span><\/p>\n
the sentence. Considering the entire facts and<\/p>\n
circumstances of the case, interest of justice<\/p>\n
will     be  met,  if  sentence  is   modified to<\/p>\n
imprisonment till rising of court and adequate<\/p>\n
compensation.\n<\/p>\n
           Revision is allowed in part. Conviction<\/p>\n
of the petitioner for the offence under Section<\/p>\n
138    of      Negotiable  Instruments  Act    is<\/p>\n
confirmed.       Sentence    is    modified.    In<\/p>\n
supersession of the sentence awarded by the<\/p>\n
learned Magistrate and confirmed by the learned<\/p>\n
Sessions     Judge,  petitioner  is  sentenced  to<\/p>\n
imprisonment      till   rising  of    court   and<\/p>\n
compensation     of   Rs.50,000\/-  (Rupees   Fifty<\/p>\n
Thousand      only)   and   in    default   simple<\/p>\n
imprisonment       for one  month.  Petitioner  is<\/p>\n
permitted to deposit\/pay the amount directly to<\/p>\n
the second respondent and establish before the<\/p>\n
learned     Magistrate  that   he  had  paid   the<\/p>\n
CRRP 322\/04              8<\/span><\/p>\n
compensation. If petitioner has deposited any<\/p>\n
amount before the learned Magistrate     pursuant<\/p>\n
to the direction given by this court while<\/p>\n
suspending     the   sentence,   petitioner   need<\/p>\n
deposit\/pay the only balance amount and the<\/p>\n
amount in deposit shall be paid to the second<\/p>\n
respondent. Petitioner is directed to appear<\/p>\n
before     the Judicial  First  Class  Magistrate,<\/p>\n
Pattambi on 7\/9\/2010.\n<\/p>\n<\/p>\n
