Justice K.SURENDRA MOHAN\n\n Dated :13\/07\/2010\n\n O R D E R\n                K.SURENDRA MOHAN, J.\n             -------------------------------------------\n                W.P.(C) No.21821 of 2010\n             -------------------------------------------\n              Dated this the 13th July, 2010\n\n                          JUDGMENT\n<\/pre>\n<p>    The petitioners are retired employees of the Kerala<\/p>\n<p>State Electricity Board (&#8216;KSEB&#8217; for short).             They have<\/p>\n<p>retired from service during the year 2000-2001 on<\/p>\n<p>attaining superannuation. However, they were not paid<\/p>\n<p>gratuity in accordance with the provisions of the Payment<\/p>\n<p>of Gratuity Act, 1973.       Therefore, they approached the<\/p>\n<p>second respondent by filing G.C.Nos.472 of 2004, 367 of<\/p>\n<p>2004 and 368 of 2004 respectively for getting their<\/p>\n<p>balance gratuity. As per Ext.P2 order, the petitioners have<\/p>\n<p>been granted the amount of gratuity due to them by the<\/p>\n<p>second respondent. Meanwhile, the third petitioner died<\/p>\n<p>and the second petitioner is his legal heir. The petitioner<\/p>\n<p>seeks payment of the gratuity due to them.<\/p>\n<p>     2. Adv.K.S.Anil who appears for the KSEB submits<\/p>\n<p>that the entire amount has been deposited with the third<\/p>\n<p>respondent and that the balance amount of gratuity could<\/p>\n<p>be paid to the petitioners on their executing bonds as<\/p>\n<p><span class=\"hidden_text\">wpc No.21821\/2010         2<\/span><\/p>\n<p>   security for such payments. The counsel for the petitioner<\/p>\n<p>   points out that such orders have been granted by this<\/p>\n<p>   Court in other Writ Petitions filed by similarly placed<\/p>\n<p>   retired employees.\n<\/p>\n<p>         3. This Writ Petition is accordingly disposed of<\/p>\n<p>   directing the second respondent to disburse to the<\/p>\n<p>   petitioners the amount of gratuity found due to them as<\/p>\n<p>   per Ext.P2 order on their furnishing security for such<\/p>\n<p>   payment by executing personal bonds.
