Rule.<br \/>\nMr.L.R.Poojari, learned APP waives service of rule on behalf of<br \/>\nrespondent nos.1 &#8211; State and 3 and Mr.Jaisingh Jadeja, learned<br \/>\nAdvocate waives service of rule on behalf of respondent no.2.\n<\/p>\n<p>2.\t\tPresent<br \/>\napplication under Sec.482 of the Code of Criminal Procedure has been<br \/>\nfiled for quashing of complaint \/ FIR registered as C.R.No.I-15 of<br \/>\n2011 before Paliyad Police Station, District &#8211; Bhavnagar  for<br \/>\nthe offences punishable under Sections 323,504, 452, 506(2) of Indian<br \/>\nPenal Code.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by Mr.N.D.Nanavaty, learned Senior Advocate for the<br \/>\napplicant that matter is settled between the parties and therefore,<br \/>\nrequested to allow the present petition.   Parties are personally<br \/>\npresent in the Court.  Settlement terms is also placed on record.<br \/>\nComplainant is present before the Court and it is submitted that<br \/>\nmatter is settled and he has no grievance against the present<br \/>\napplicant. Therefore, it is requested to quash the complaint.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAdvocate for the applicant has relied upon following decisions in<br \/>\nsupport of his submission :-\n<\/p>\n<p>(i)\tRajeshbhai<br \/>\nNatvarlal Agarwal v\/s. State of Gujarat [2005 (3) GLH 504]<\/p>\n<p>(ii)\tJagdish<br \/>\nChanana &amp; Ors. v\/s. State of Haryana [AIR 2008 SC 1968]<\/p>\n<p>(iii)\tMadan<br \/>\nMohan Abbot v\/s. State of Punjab [AIR 2008 SC 1969]<\/p>\n<p>5.\t\tThe<br \/>\nApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\n(supra) has observed as under<br \/>\nin paras 5 and 7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt<br \/>\nis on the basis of this compromise that the application was filed in<br \/>\nthe High Court for quashing of proceedings which  has been dismissed<br \/>\nby the impugned order.  We notice from a  reading of the FIR and the<br \/>\nother documents on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7.\n<\/p>\n<p>We see from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of  proceedings.  The<br \/>\nouter limit of Rs.250\/- which has led to the dismissal of the<br \/>\napplication is an irrelevant factor in the later case.  We<br \/>\naccordingly allow the appeal and in the peculiar facts of the case,<br \/>\ndirect that  FIR No.155 dated 17th November 2001 P.S. Kotwali,<br \/>\nAmritsar and all proceedings connected therewith shall be deemed to<br \/>\nbe quashed.&#8221;\n<\/p>\n<p>6.\t\tConsidering<br \/>\naforesaid decision of the Hon&#8217;ble Supreme Court and settlement<br \/>\narrived between the parties, in opinion of this Court, no useful<br \/>\npurpose would be served in continuing with the criminal proceedings<br \/>\nand it will be harassment to the parties.  Hence, a case is made out<br \/>\nto exercise powers under section 482 of Criminal Procedure Code.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, present application is allowed.  The  FIR being<br \/>\nC.R.No.I-15 of 2011 registered with Paliyad Police Station, District<br \/>\nBhavnagar and the proceedings therein are required to be quashed and<br \/>\nare accordingly quashed. Rule is made absolute to the aforesaid<br \/>\nextent.
