     Petitioner constructed a twin house.            He submitted a<\/p>\n
return as per the provisions of the Kerala Building Tax Act<\/p>\n
treating the two buildings as separate and independent. Both<\/p>\n
the building were numbered by the local authority separately.<\/p>\n
According to him, each building has got an independent<\/p>\n
existence and to be enjoyed independently. Access to the two<\/p>\n
buildings are separate. Exit and entry to the buildings are<\/p>\n
separate. Both have got separate electricity connection and<\/p>\n
water connection. Thus the enjoyment of one does not depend<\/p>\n
upon the other. But the authority treated both the building as a<\/p>\n
single unit for the purpose of computing the tax under the<\/p>\n
Kerala Building Tax Act, 1975.          In other words, the area<\/p>\n
occupied by both the buildings together were taken as a single<\/p>\n
unit for the purpose of assessment.           There was an appeal<\/p>\n
against the assessment order which is earlier allowed by way of<\/p>\n
a remand to the assessing authority. Thereafter, the same view<\/p>\n
is taken by the assessing officer by Ext.P1 order. Exts.P2, P3<\/p>\n

and P4 are demand notices by the 3rd respondent. Though the<\/p>\n
petitioner preferred an appeal on the question of clubbing of two<\/p>\n
buildings for the purpose of assessment, the same was decided<\/p>\n
against the petitioner confirming the order of the assessing<\/p>\n
officer.   The revisional authority has also confirmed the same.<\/p>\n
Hence this writ petition.\n<\/p>\n<\/p>\n
      2.    Ext.P5 order is the final order passed by the authority<\/p>\n
rejected the contention of the petitioner. The only reason for<\/p>\n
treating the two buildings together as per Ext.P6 is that both the<\/p>\n
buildings have got a common septic tank with one soakpit and no<\/p>\n
other distinct features were shown for treating the two buildings<\/p>\n
as one unit.     Petitioner contends that this approach by the<\/p>\n
authority is totally against the accepted principle as to how the<\/p>\n
two buildings has to be treated whether as a single unit or a<\/p>\n
different unit. According to him, the mere fact that the two<\/p>\n
buildings are owned by the same person by itself is no reason to<\/p>\n
hold that the area occupied by two buildings could be clubbed<\/p>\n
together for the purpose of assessment and treat the same as a<\/p>\n
single unit.     The mere fact that two buildings are situated<\/p>\n
adjacent with the common wall in between also does not make<\/p>\n

any difference so long as such constructions are permissible<\/p>\n
under the Kerala Building Rules. If, two neighboring owners<\/p>\n
agreed for construction of a building that there could be a<\/p>\n
common wall in between and if there is no such prohibition<\/p>\n
under the Kerala Building Rules for the purpose of construction<\/p>\n
of such type of buildings as agreed to by them, then there is no<\/p>\n
reason to hold that the two buildings are to be treated as one<\/p>\n
building, especially, since the Apartment Ownership Act has<\/p>\n
already come into force in the State of Kerala, different<\/p>\n
apartments one above the other would still be owned and<\/p>\n
possessed by different persons.    Therefore, the criteria to be<\/p>\n
adopted in the matter of treating two buildings as one unit is to<\/p>\n
see whether both the buildings could separately be enjoyed;<\/p>\n
whether there were different electricity connection; whether one<\/p>\n
building could be enjoyed without entering through the other<\/p>\n
building,    in  other words   whether    two  buildings   could<\/p>\n
independently exist in the matter of enjoyment of same is a<\/p>\n
relevant factor. As per the decision of this Court in Lalitha v.<\/p>\n
State of Kerala<\/a> [1994(2) KLT 66], the learned Judge held after<\/p>\n
considering the relevant portion of Kerala Building Tax Act that<\/p>\n
there is no provision in the Act for clubbing together various<\/p>\n

buildings constructed by the same owner which are otherwise<\/p>\n
separate either in the same financial year or otherwise. Two<\/p>\n
separate units may constitute one building, if they are built for<\/p>\n
the purpose of one or the other, and are functionally integrated.<\/p>\n
For example, a house with a garage, out-house for servants,<\/p>\n
latrines, cow-shed and so on forms an integral unit and has to be<\/p>\n
assessed as such. A hotel complex which may consist of<\/p>\n
numerous buildings like, cottages, kitchen complex, shopping<\/p>\n
arcade and so on or a factory complex with its appendages may<\/p>\n
constitute one unit for the purpose of assessment. But when<\/p>\n
there is no such inherent connection between the buildings,<\/p>\n
when they do not exist for each other and are otherwise<\/p>\n
separate,    there is no provision anywhere in the Act which<\/p>\n
requires such separate entities clubbed together into one or<\/p>\n
which deems them to be one building. Therefore, it was held<\/p>\n
that merely because two buildings are owned by the same person<\/p>\n
there is no criterion to treat the two buildings as one unit. The<\/p>\n
question as to whether the two buildings in question could be<\/p>\n
clubbed together therefore depends upon the facts and<\/p>\n
circumstances of each case. In the present case, the only<\/p>\n
distinction drawn by the revisional authority is that there is no<\/p>\n

separate septic tank. No other distinct feature has been shown.<\/p>\n
Learned Government Pleader however pointed out that there is<\/p>\n
only one approved building plan for the two buildings. But this<\/p>\n
argument does not appeal to me. A huge building with several<\/p>\n
apartments, the builder gives only one         plan for approval<\/p>\n
consisting of all the independent flats and they are constructed<\/p>\n
based on the agreement between the intending buyer and the<\/p>\n
builder. It has since been held by the Division Bench of this<\/p>\n
Court that if the construction is made by the builder using the<\/p>\n
funds with separate funds provided by the intending buyer then<\/p>\n
such flats are to be treated as separate units. Therefore the fact<\/p>\n
that a combined plan is given is also not a decessive test by itself<\/p>\n
to treat the buildings as one unit. In the circumstances, Ext.P6<\/p>\n
is quashed and the matter is remanded to the revisional<\/p>\n
authority for fresh consideration in accordance with law after<\/p>\n
hearing the petitioner. The interim stay granted by this Court<\/p>\n
will continue till fresh orders are passed by the revisional<\/p>\n
authority<\/p>\n
