Justice M.SASIDHARAN NAMBIAR\n\n Dated :03\/06\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO. 1536 OF 2009\n              ------------------------------------------\n\n                 Dated 3rd           June 2009\n\n\n                           O R D E R\n<\/pre>\n<p>           Petitioner had received Rs.15,00,000\/- from<\/p>\n<p>Sabarinath, the accused in the case being investigated<\/p>\n<p>by C.B.C.I.D in crime 169\/2008 of Medical college<\/p>\n<p>police  station.   During        investigation          finding that<\/p>\n<p>Rs.15,00,000\/- which was received from Sabarinath is<\/p>\n<p>available with the petitioner, investigating officer<\/p>\n<p>issued Annexure-II notice directing him to take a<\/p>\n<p>demand  draft  for     Rs.15,00,000\/-              in   the name   of<\/p>\n<p>Additional Chief Judicial Magistrate and produce it<\/p>\n<p>before the Deputy Police Superintendent, Crime Branch,<\/p>\n<p>CID,   Kowdiar. Meanwhile, petitioner also received<\/p>\n<p>Annexure-III notice from official Receiver                  appointed<\/p>\n<p>by   Insolvency      court          (Additional          Sub    court<\/p>\n<p>Thiruvananthapuram) in O.P.(IP) No.2\/2008 directing<\/p>\n<p>him to remit Rs.15,00,000\/- received by him from<\/p>\n<p>Sabarinath as advance.        Petitioner filed this petition<\/p>\n<p>under  Section  482     of     Code      of     Criminal    Procedure<\/p>\n<p>contending that he cannot deposit the amount both<\/p>\n<p><span class=\"hidden_text\">CRMC 1536\/09                 2<\/span><\/p>\n<p>before  the  investigating     officer    as  well   as<\/p>\n<p>insolvency   court  and   contending   that   in   such<\/p>\n<p>circumstances, Annexures-I and II are to be quashed.<\/p>\n<p>          2.  Learned counsel appearing for petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>          3.  Learned counsel appearing for petitioner<\/p>\n<p>submitted that he is prepared to deposit the amount<\/p>\n<p>either  before  the  Insolvency  court  or  before  the<\/p>\n<p>Additional Chief Judicial Magistrate as this court<\/p>\n<p>directs and necessary directions may be issued. Learned<\/p>\n<p>Public Prosecutor    on instructions    submitted that<\/p>\n<p>petitioner be directed to deposit the amount before the<\/p>\n<p>Insolvency  court    where  a   petition to     declare<\/p>\n<p>Sabarinath insolvent is pending.
