SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/03\/2009 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioner has<br \/>\n\tchallenged  the action of the respondent No.1 in considering the<br \/>\n\tcase of the respondent No.1  for the post of Weaving Assistant  \/<br \/>\n\tCraftsman on the ground that the post in question was reserved  for<br \/>\n\tthe candidate belonging to  the Scheduled  Caste \/ Scheduled Tribes<br \/>\n\tis holding qualification of Diploma in Textile  Manufacturer (DTM).\n<\/p>\n<p>It<br \/>\n\tis required to be noted that while admitting the presents Civil<br \/>\n\tApplication, the learned Single Judge vide order dtd.24\/8\/1993 has<br \/>\n\tgranted interim relief in terms of para 24(D) and the said interim<br \/>\n\trelief has been continued till date.  Though served, nobody appears<br \/>\n\ton behalf of the respondent No.2. Thus, it appears  that the<br \/>\n\trespondent No.2 is not aggrieved by the interim relief.\n<\/p>\n<p>Mr.Maulik<br \/>\n\tR.Shah, learned  advocate appearing for Nanavati Associates for the<br \/>\n\trespondent No.1 has submitted that as such the petition under<br \/>\n\tArticle 226 of the Constitution of India is not maintainable as the<br \/>\n\trespondent No.1 cannot be said to be a State within the meaning of<br \/>\n\tArticle 12 of the Constitution of India. However, without prejudice<br \/>\n\tto his above contention,  he has submitted that when the  respondent<br \/>\n\tNo.1 is restrained from considering the case of the respondent No.2<br \/>\n\tfor the post of  Weaving Assistant  \/ Craftsman since 1993 and the<br \/>\n\tsaid interim relief has been continued till today, the respondent<br \/>\n\tNo.1 would not like to consider the case of the respondent No.2 now.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances and in view of the  above statement made by the<br \/>\n\tlearned advocate appearing on behalf of the respondent No.1 and in<br \/>\n\tview of the fact that the interim relief  has been continued till<br \/>\n\ttoday, no further order is required to be passed except making the<br \/>\n\tinterim relief granted earlier absolute and the present petition is<br \/>\n\taccordingly disposed of. However, the question with respect to the<br \/>\n\tmaintainability of the petition against the respondent No.1 is kept<br \/>\n\topen and this Court has not expressed any opinion on merits with<br \/>\n\trespect to the same. However, it is observed that as and when the<br \/>\n\trespondent No.1 proposes to fill up the post in question, the same<br \/>\n\tshall be filled in in accordance with law.
