RAVIKUMAR, JJ.\n\n                  ------------------------------\n                     W.A.No.2952 of 2007\n                  ------------------------------\n\n            Dated this, the 11th day of August, 2009\n\n                          JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>           The appellant was the writ petitioner. He was a<\/p>\n<p>teacher working under the respondents.         He was removed<\/p>\n<p>from service by the decision of the second respondent with<\/p>\n<p>effect from 25.9.2003, by resolution dated 5.12.2002. By the<\/p>\n<p>order of the second respondent, the secretary of the first<\/p>\n<p>respondent has communicated the same to the appellant by<\/p>\n<p>Ext.P12 dated 8.12.2002.        Challenging Ext.P12, the writ<\/p>\n<p>petition was filed. The learned Single Judge took the view that,<\/p>\n<p>since the appellant has a right of appeal to the General Council<\/p>\n<p>under Rule 51 of the Unnayi Warrier Smaraka Kalanilayam<\/p>\n<p>Service Rules, the appellant has to invoke that remedy. As<\/p>\n<p>per the judgment under appeal, it was ordered that if the<\/p>\n<p>appellant invokes the alternative remedy within one month<\/p>\n<p>from the date of that judgment, the appeal shall be<\/p>\n<p>entertained and dealt with as filed in time. But the appellant,<\/p>\n<p>W.A.No.2952 of 2007:\n<\/p>\n<p>                              &#8211; 2 &#8211;\n<\/p>\n<p>instead of invoking the said appellate remedy filed the writ<\/p>\n<p>appeal.\n<\/p>\n<p>           2. We heard the learned counsel for the appellant.<\/p>\n<p>The learned counsel tried to canvass that Ext.P12 has been<\/p>\n<p>issued by the Secretary who is not the competent authority.<\/p>\n<p>So, Ext.P12 is issued without jurisdiction and, therefore, this<\/p>\n<p>Court should have quashed the impugned order, instead of<\/p>\n<p>turning him away to invoke the appellate remedy. We notice<\/p>\n<p>that, the decision in Ext.P12 has been taken by the Managing<\/p>\n<p>Committee, which has been communicated by the Secretary<\/p>\n<p>of the first respondent.    At every stage of the disciplinary<\/p>\n<p>proceedings, as will be evident from Ext.P12, the decision was<\/p>\n<p>taken by the Managing Committee. The Secretary being the<\/p>\n<p>executing authority, was communicating the decision. So, the<\/p>\n<p>said contention of the appellant cannot be accepted. Once the<\/p>\n<p>learned Single Judge dismisses the writ petition       on the<\/p>\n<p>ground of availability of alternative remedy, an appeal under<\/p>\n<p>Section 5 of the Kerala High Court Act is not maintainable,<\/p>\n<p>unless it is shown that the exercise of discretion by the<\/p>\n<p>W.A.No.2952 of 2007:\n<\/p>\n<p>                              &#8211; 3 &#8211;\n<\/p>\n<p>learned Single Judge is perverse. Going by the facts of the<\/p>\n<p>case, it cannot be held that, the decision of the learned Single<\/p>\n<p>Judge is perverse.\n<\/p>\n<p>           In the result, the Writ Appeal is dismissed, without<\/p>\n<p>prejudice to the contentions of the appellant. If the appellant<\/p>\n<p>prefers the appeal before the General Council as directed by<\/p>\n<p>the learned Single Judge, the period this writ appeal was<\/p>\n<p>pending before this Court shall be excluded while computing<\/p>\n<p>the period fixed by the learned Single Judge for filing the<\/p>\n<p>appeal.\n<\/p>\n<\/p>\n<p>                                               Sd\/-\n<\/p>\n<p>                                   K.
