No. 5097\/2010 (s)\n3\/05\/2010\n        Shri Sanjay Singh, learned counsel for the petitioner.\n        Shri Puneet Shroti, learned Panel Lawyer for the State.\n        Petitioner is working as an Assistant Grade-III in the\noffice of Executive Engineer E\/M, Light Machinery, Bhopal.\n        Grievance of the petitioner is that on the ground that\nshe has not passed the Hindi Typing test, increment from the\ninitial date of appointment is not granted to her but is only\ngranted from the date after she had passed the Hindi Typing\ntest.\n        It is not in dispute that appointment of the petitioner is\ngoverned by the statutory provisions namely the Madhya\nPradesh     Irrigation   Department    (Non-Gazetted     Service)\nRecruitment Rules, 1969.           Under rule 8 of the said\nrecruitment rule, there is no condition of passing a Typing\ntest. A matriculate or a person having passed the equivalent\nexamination is eligible to be appointed on the clerical post.\nThat being so, it is the case of the petitioner that she is\nentitled to increment and on the ground that she has not\npassed the Hindi Typing test which is not a condition\nstipulated in the statutory rule, increment cannot be denied\nto her.\n        The said question involved in this petition stands\nresolved by a judgment rendered in the case of Dongar\nSingh Pawar Vs. State of M. P. and others, 2006 (3),\nM. P. H. T. 352 and various other orders passed following\nthe aforesaid judgment.\n        Keeping in view the considered view of this Court,\n respondents are directed to grant increment to the petitioner<\/pre>\n<p>in accordance with the law laid down in the case of Dongar<br \/>\nSingh Pawar (supra) .\n<\/p>\n<p>      Increments be calculated and arrears be paid to the<br \/>\npetitioner within a period of two months from the date of<br \/>\nreceipt of certified copy of this order and proper pay fixation<br \/>\nbe also done within the aforesaid period.\n<\/p>\n<p>      Petition stands allowed and disposed of with the<br \/>\naforesaid.\n<\/p>\n<p>                                            (Rajendra Menon)<br \/>\n                                                Judge<br \/>\nVy\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Smt.
