The<br \/>\nappellant has also accepted that he has received the reply from Hod. Deptt., Bldg. Deptt. and Works<br \/>\nDeptt. The appeal is disposed of.\n<\/p>\n<p>Ground of the Second Appeal:\n<\/p>\n<p>The information provided is unsatisfactory and incomplete<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant : Absent;\n<\/p>\n<p>Respondent : Mr. K. C. Meena, Public Information Officer &amp; SE-II; Mr. Bal Krishan Kapoor, LDC,<br \/>\nDUSIB and Mr. Jeet Ram, Architect, DUSIB;\n<\/p>\n<p>        The respondent shows that with regards to query-1(a) &amp; (c) the PIO Sr. Town Planner (L) has<br \/>\ninformed the Appellant on 14\/02\/2011 that the layout plan of Nangloi Site no-I, Phase-I is available.<br \/>\nThe PIO of Town Planning Department instead of sending the plan has asked the Appellant to inspect<br \/>\nthe same at the office and pay requisite fee for obtaining it. The RTI application has been filed on<br \/>\n10\/12\/2010. Since the information was delayed beyond 30 days it should have been sent free of cost to<br \/>\nthe appellant. As regards query query-1(b) &amp; 2 the RTI application has been transferred to DDA and<br \/>\nthe Department of Industries.\n<\/p>\n<p>The PIO DUSIB states that the RTI application came to him on 06\/06\/2011. He states that he also has<br \/>\nthe information and has sent the copy of the plan to the Appellant on 08\/06\/2011. He states that he<br \/>\nwould also be able to provide the balance information before 30 June 2011 regarding queries 1(b), 1(c)<br \/>\n&amp; 02.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>       The PIO of DUSIB is directed to provide the information on queries 1(b), (c) &amp;<br \/>\n02 to the Appellant before 25 June 2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO\/Sr. Town Planner within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it appears that the PIO\/Sr. Town Planner is guilty of not<br \/>\nfurnishing information within the time specified under sub-section (1) of Section 7 by not replying<br \/>\nwithin 30 days, as per the requirement of the RTI Act. It appears that the PIO&#8217;s actions attract the<br \/>\npenal provisions of Section 20 (1). A showcause notice is being issued to him, and he is directed give<br \/>\nhis reasons to the Commission to show cause why penalty should not be levied on him.\n<\/p>\n<p>PIO\/Sr. Town Planner will present himself before the Commission at the above address on 04 July<br \/>\n2011 at 10.30am alongwith his written submissions showing cause why penalty should not be<br \/>\nimposed on him as mandated under Section 20 (1).
