Justice A.K.BASHEER\n\n Dated :25\/05\/2007\n\n O R D E R\n                                A.K.BASHEER, J.\n\n                 ----------------------------------------------------------\n\n                   W.P.(C)Nos.14897 &amp; 14898 of 2007\n\n                 ----------------------------------------------------------\n\n                   Dated this the 25th day of May, 2007\n\n\n                                    JUDGMENT\n<\/pre>\n<p>      Since common  reliefs have been sought for in these two<\/p>\n<p>writ     petitions,   they   are   being   disposed   of   through   this<\/p>\n<p>common judgment.\n<\/p>\n<p>      2.  Petitioners are students in 3rd year BAMS (Bachelor of<\/p>\n<p>Ayurvedic   Medicine   and   Surgery)   in   Parassinikadavu<\/p>\n<p>Ayurveda   Medical   College   which   is   affiliated   to   the   Kannur<\/p>\n<p>University.   The  3rd  year University examination is scheduled<\/p>\n<p>to   commence   from   June   6,   2007.     However,   petitioners   face<\/p>\n<p>the   prospect   of   being   disallowed   to   write   the   examination<\/p>\n<p>since   they   have   not   passed   the   entire   papers   in   the   second<\/p>\n<p>year  course.      While petitioner  in  Writ   Petition   No.14897  of<\/p>\n<p>2007   is   yet   to   pass   the   examination   in   &#8216;Charaka   Samhitha&#8217;<\/p>\n<p>(Poorvardham),   the   petitioner   in   Writ   Petition   No.14898   of<\/p>\n<p>2007   is   yet   to   pass   the   examination   in   &#8216;Rasasasthra   and<\/p>\n<p>Baishajya Kalpana&#8217;.  It is the admitted position that only those<\/p>\n<p>students   who   have   passed   all   the   papers   in   first   and   second<\/p>\n<p>W.P.(C)Nos.14897 &amp; 14898 of 2007<\/p>\n<p>                                    ::  2  ::\n<\/p>\n<p>year   examinations   will   be   eligible   to   write   the   3rd  year<\/p>\n<p>examination.  It is also not in dispute that the petitioners have<\/p>\n<p>made a request to the University for revaluation of the papers<\/p>\n<p>in which they have  failed.   Those applications are admittedly<\/p>\n<p>pending before the University.\n<\/p>\n<p>      3.   I have heard learned  counsel  for the petitioners and<\/p>\n<p>learned Standing Counsel for the University.\n<\/p>\n<p>      4.     It   is   submitted   by   learned   Standing   Counsel   after<\/p>\n<p>getting   instructions   from   the   University   that   it   may   not   be<\/p>\n<p>possible   for   the   University   to   get   the   two   papers   revalued<\/p>\n<p>before the commencement of the examination.  He also points<\/p>\n<p>out  that  the  papers   may   have   to  be   sent  to  a  third   valuer,  if<\/p>\n<p>there   is   a   difference   of   more   than   5%   in   the   marks   after<\/p>\n<p>revaluation;   which   again   may   result   in   further   delay.     The<\/p>\n<p>grievance of the petitioners is that they are likely to lose one<\/p>\n<p>academic   year,   if   they   are   not   allowed   to   write   the   3rd  year<\/p>\n<p>examination.\n<\/p>\n<p>W.P.(C)Nos.14897 &amp; 14898 of 2007<\/p>\n<p>                                    ::  3  ::\n<\/p>\n<p>     5.  In the peculiar facts and circumstances, I am satisfied<\/p>\n<p>that these writ  petitions can be disposed of with the following<\/p>\n<p>directions:\n<\/p>\n<blockquote><p>    a) The University shall take expeditious steps to ensure<\/p>\n<p>    that the two papers of the petitioners namely &#8216;Charaka<\/p>\n<p>    Samhitha   (Poorvardham)   of   the   petitioner   in     Writ<\/p>\n<p>    Petition   No.14897   of   2007   and     &#8216;Rasasasthra   and<\/p>\n<p>    Baishajya   Kalpana&#8217;   of   the   petitioner   in   Writ     Petition<\/p>\n<p>    No.14898   of   2007   are   revalued   as   expeditiously   as<\/p>\n<p>    possible,   at   any   rate,   within   two   months   from   today.<\/p>\n<p>    The result of revaluation shall be communicated to the<\/p>\n<p>    petitioners without any delay.<\/p><\/blockquote>\n<p>    b)     Petitioners   shall   be   allowed   to   appear   for   the   3rd<\/p>\n<p>    year   examination   which   is   scheduled   to   commence<\/p>\n<p>    from   June   6,   2007   or   any   other   subsequent   date,<\/p>\n<p>    provisionally subject to the result of the revaluation.  If<\/p>\n<p>W.P.(C)Nos.14897 &amp; 14898 of 2007<\/p>\n<p>                                     ::  4  ::\n<\/p>\n<p>       the petitioners fail to secure pass marks even after the<\/p>\n<p>       revaluation,   the   papers   in   the   3rd  year   examination<\/p>\n<p>       which   they   are   allowed   to   write   provisionally   will   be<\/p>\n<p>       treated as invalid.
