Leave granted.\n<\/p>\n<p>2.   Challenge in these appeals is to the judgment of the<\/p>\n<p>learned Single Judge of the Andhra Pradesh High Court<\/p>\n<p>allowing the Civil Revision Petition Nos.5048 and 5088 of<\/p>\n<p>2001, filed by the present respondent no.1 in each case. In<\/p>\n<p>the civil revision petition it was indicated that the proforma<br \/>\nrespondents in these appeals were not necessary parties. The<\/p>\n<p>basic dispute relates to liability to interest on the amount<\/p>\n<p>envisaged under Section 23(2) of the Land Acquisition Act,<\/p>\n<p>1894 (in short the `Act&#8217;) conveniently called &#8220;solatium&#8221;. The<\/p>\n<p>High Court allowed the civil revision petitions being of the view<\/p>\n<p>that the decision of this Court in Prem Nath Kapur and Anr. v.\n<\/p>\n<p>National Fertilizer Corpn. of India Ltd. and Ors. (1996 (2) SCC<\/p>\n<p>71) was overruled by the Constitution Bench of this Court in<\/p>\n<p><a href=\"\/doc\/531626\/\">Sunder v. Union of India<\/a> (2001 (7) SCC 211).\n<\/p>\n<p>3.   Mr. Amrendra Sharan, Additional Solicitor General,<\/p>\n<p>submitted that both Prem Nath&#8217;s case (supra) and Sunder&#8217;s<\/p>\n<p>case (supra) were considered by a Constitution Bench of this<\/p>\n<p>Court in <a href=\"\/doc\/1736128\/\">Gurpreet Singh v. Union of India<\/a> (2006 (8) SCC 457).\n<\/p>\n<p>It was submitted that view in Prem Nath&#8217;s case (supra) was<\/p>\n<p>stated to be correct one in the said case. Therefore, the view of<\/p>\n<p>the High Court cannot be maintained.\n<\/p>\n<p><span class=\"hidden_text\">                                                             2<\/span><\/p>\n<p>4.   In   response,       learned   counsel   for   the   respondent<\/p>\n<p>submitted that the High Court&#8217;s judgment does not suffer<\/p>\n<p>from any infirmity to warrant interference.\n<\/p>\n<p>5.   In Gurpreet Singh&#8217;s case (supra) this Court observed,<\/p>\n<p>inter alia, as follows:\n<\/p>\n<blockquote><p>           &#8220;53. Thus, on the whole, we are satisfied that<br \/>\n           the essential ratio in Prem Nath Kapur (1996<br \/>\n           (2) SCC 71) on appropriation being at different<br \/>\n           stages is justified though if at a particular<br \/>\n           stage there is a shortfall, the awardee-decree-<br \/>\n           holder would be entitled to appropriate the<br \/>\n           same on the general principle of appropriation,<br \/>\n           first towards interest, then towards costs and<br \/>\n           then towards the principal, unless, of course,<br \/>\n           the deposit is indicated to be towards specified<br \/>\n           heads by the judgment-debtor while making<br \/>\n           the deposit intimating the decree-holder of his<br \/>\n           intention. We, thus, approve the ratio of Prem<br \/>\n           Nath Kapur on the aspect of appropriation.\n<\/p><\/blockquote>\n<blockquote><p>           54. One other question also was sought to be<br \/>\n           raised and answered by this Bench though not<br \/>\n           referred to it. Considering that the question<br \/>\n           arises in various cases pending in courts all<br \/>\n           over the country, we permitted the counsel to<br \/>\n           address us on that question. That question is<br \/>\n           whether in the light of the decision in Sunder<br \/>\n           (2001 (7) SCC 211), the awardee\/decree-holder<br \/>\n           would be entitled to claim interest on solatium<br \/>\n           in execution though it is not specifically<br \/>\n           granted by the decree. It is well settled that an<br \/>\n           execution court cannot go behind the decree.<\/p><\/blockquote>\n<p>           If, therefore, the claim for interest on solatium<br \/>\n           had been made and the same has been<br \/>\n           negatived either expressly or by necessary<br \/>\n           implication by the judgment or decree of the<br \/>\n           Reference Court or of the appellate court, the<br \/>\n           execution court will have necessarily to reject<br \/>\n           the claim for interest on solatium based on<\/p>\n<p><span class=\"hidden_text\">                                                                 3<\/span><br \/>\n          Sunder on the ground that the execution court<br \/>\n          cannot go behind the decree. But if the award<br \/>\n          of the Reference Court or that of the appellate<br \/>\n          court does not specifically refer to the question<br \/>\n          of interest on solatium or in cases where claim<br \/>\n          had not been made and rejected either<br \/>\n          expressly or impliedly by the Reference Court<br \/>\n          or the appellate court, and merely interest on<br \/>\n          compensation is awarded, then it would be<br \/>\n          open to the execution court to apply the ratio<br \/>\n          of Sunder and say that the compensation<br \/>\n          awarded includes solatium and in such an<br \/>\n          event interest on the amount could be directed<br \/>\n          to be deposited in execution. Otherwise, not.<br \/>\n          We also clarify that such interest on solatium<br \/>\n          can be claimed only in pending executions and<br \/>\n          not in closed executions and the execution<br \/>\n          court will be entitled to permit its recovery<br \/>\n          from the date of the judgment in Sunder (19-9-<br \/>\n          2001) and not for any prior period. We also<br \/>\n          clarify that this will not entail any<br \/>\n          reappropriation or fresh appropriation by the<br \/>\n          decree-holder. This we have indicated by way<br \/>\n          of clarification also in exercise of our power<br \/>\n          under Articles 141 and 142 of the Constitution<br \/>\n          of India with a view to avoid multiplicity of<br \/>\n          litigation on this question.&#8221;\n<\/p>\n<p>6.   In view of what has been stated above, it would be<\/p>\n<p>appropriate for the High Court to consider the matter afresh in<\/p>\n<p>view of the aforesaid quoted observations of this Court.\n<\/p>\n<p>Accordingly, the matter is remitted to the High Court for fresh<\/p>\n<p>consideration.\n<\/p>\n<p>7.
