Respondents\n\nPrayer\n\nWrit Petition filed under Article 226 of the Constitution of India,\npraying for issuance of a Writ of Certiorarified Mandamus, calling for the\nrecords of the impugned notice of the second respondent dated 06.09.2008, quash\nthe same and consequently direct the first and second respondents to permit the\npetitioner to conduct Sri Valli Thirumanam Nadagam in the Sri Balarudaiya\nIyyanar temple.\n\n!For Petitioner     ...Mr.B.Pugalendhi\n^For Respondents    ...Mr.D.Sasikumar\n\t\t       Govt.Advocate\n\n:ORDER\n<\/pre>\n<p>\t\tThis writ petition has been filed to call for the records of the<br \/>\nimpugned notice of the second respondent dated 06.09.2008, quash the same and<br \/>\nconsequently direct the first and second respondents to permit the petitioner to<br \/>\nconduct Sri Valli Thirumanam Nadagam in the Sri Balarudaiya Iyyanar temple.\n<\/p>\n<p>\t2. Heard the learned counsel for the petitioner and also Mr.D.Sasikumar,<br \/>\nlearned Government Advocate, appearing for the respondents.\n<\/p>\n<p>\t3. The grievance of the petitioner as aired by the learned counsel for the<br \/>\npetitioner placing reliance on the averments in the affidavit accompanying the<br \/>\nwrit petition, is to the effect the petitioner wants to stage a drama viz., Sri<br \/>\nValli Thirumanam in Sri Balarudaiya Iyyanar Temple, North Visavanoor Village,<br \/>\nIlayankudi Taluk, Sivagangai District, which he has been doing on earlier<br \/>\noccasions; however the police refused to grant permission to conduct the same.<br \/>\nHence, this writ petition.\n<\/p>\n<p>\t4. The perusal of the impugned communication dated 06.09.2008, would<br \/>\nreveal that due to some law and order problem, the first respondent viz., the<br \/>\nDeputy Superintendent of Police, Sivagangai refused permission and the same was<br \/>\ncommunicated by the second respondent, viz., the Inspector of Police, Salai<br \/>\nGramam Police Station, Sivagangai District to the petitioner.\n<\/p>\n<p>\t5. The learned counsel for the petitioner would submit that the petitioner<br \/>\nis going to conduct only a drama and that he will also distribute food at the<br \/>\nrelevant time to the gathering there and he would not pave the way for any law<br \/>\nand order problem.\n<\/p>\n<p>\t6. The learned Government Advocate would highlight that several cases were<br \/>\nbooked in the recent past also, because there had been clash between two<br \/>\ncommunities, whereas the learned counsel for the petitioner would submit that<br \/>\nmore than 105 persons of that locality supported the petitioner for conducting<br \/>\nsuch a drama and for distribution of food at the temple.\n<\/p>\n<p>\t7. Without in any way deciding as to the ownership over the temple or any<br \/>\nother right of the petitioner over the temple, I would like to issue the<br \/>\nfollowing direction:\n<\/p>\n<p>\tThe Revenue Divisional Officer concerned and the first respondent, viz.,<br \/>\nthe Deputy Superintendent of Police, Sivagangai shall convene a meeting of the<br \/>\npetitioner and the rival group, if any, and see to it that the petitioner<br \/>\nconducts the drama amicably which will not in any way confer on the petitioner,<br \/>\nany right over the said temple.\n<\/p>\n<p>\t8. The learned counsel for the petitioner would also submit that if any<br \/>\nexpenditure has to be met by the petitioner for providing police protection,<br \/>\nthen he is also ready to deposit necessary charges with the Government in this<br \/>\nregard.  Accordingly, the matter shall be processed within a period of fifteen<br \/>\ndays from the date of receipt of a copy of this order.\n<\/p>\n<p>\t9. With the above said directions, this Writ Petition is disposed of.  No<br \/>\ncosts.
