It also<br \/>\nappears that they are first cousins and the victim girl has been<br \/>\nbetrothed with one another boy. It is admitted by the father in the<br \/>\nF.I.R. that the applicant-accused wants to get married to his<br \/>\ndaughter but as she is already betrothed to one another boy, they<br \/>\nwould not like to break the betrothal. However, in the F.I.R. itself<br \/>\nthe first informant has made it clear that he has lodged the F.I.R.<br \/>\nafter 11 days only because he apprehended some problem at the end of<br \/>\nthe accused applicant. In this view of the matter, I am persuaded to<br \/>\nexercise my discretion in favour of the applicant &#8211; accused,<br \/>\ntaking into consideration the following aspects:-\n<\/p>\n<p>(a)<br \/>\nThe accused-applicant and the girl are first \tcousins. Father of the<br \/>\naccused-applicant and the \tmother of the victim girl are brother and<br \/>\n\tsister.\n<\/p>\n<p>(b)<br \/>\nThere appears to be some intimacy between each \tother. Of course, the<br \/>\nfact has been denied by \tthe victim girl.\n<\/p>\n<p>(c)<br \/>\nThere is a delay of about 11 days in lodging the \tF.I.R. and the same<br \/>\nhas been lodged only on \tapprehension of some problem once again at<br \/>\nthe \tend of the accused-applicant.\n<\/p>\n<p>(d)\tInvestigation<br \/>\nis practically over.\n<\/p>\n<p>\tTaking<br \/>\ninto consideration the relevant aspects referred to above and further<br \/>\ntaking into consideration the law laid down by the Apex Court in the<br \/>\ncase of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra &amp;<br \/>\nOrs.,<\/a> reported<br \/>\nin (2011) 1 SCC 694, wherein the Hon&#8217;ble Supreme Court<br \/>\nreiterated the law laid down by the constitutional Bench in the case<br \/>\nof Shri Gurubaksh Singh Sibbia &amp; Ors. (1980) 2 SCC 565,<br \/>\nthe accused &#8211; applicant, namely, Lalbhai Ghanshyamsinh<br \/>\nParmar is ordered to be enlarged on anticipatory bail in the<br \/>\nevent of his arrest in connection with the offence registered with<br \/>\nMadhupura  Police Station, Ahmedabad vide I-CR No.94\/2011, on<br \/>\nfurnishing bond of Rs.15,000\/- (Rupees Fifteen Thousand Only) with<br \/>\none surety of like amount to the satisfaction of the trial Court, on<br \/>\nthe following conditions that :-\n<\/p>\n<p>[A]\the<br \/>\nshall cooperate with the investigation and make himself available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[B]\the<br \/>\nshall not enter the revenue limits of Ahmedabad city till the<br \/>\nconclusion of the trial.\n<\/p>\n<p>[C]\the<br \/>\nshall remain present at the concerned Police Station on 20th<br \/>\nMay 2011 between 10 a.m. and 2 p.m. and mark his presence before the<br \/>\nconcerned Police Station twice in a month on every 2nd and<br \/>\n4th Saturday till the filing of the charge-sheet;\n<\/p>\n<p>[D]\the<br \/>\nshall not hamper the investigation in any manner nor he shall<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nwitness so as to dissuade them from disclosing such facts to the<br \/>\nCourt or to any Police Officer;\n<\/p>\n<p>[E]\the<br \/>\nshall, at the time of execution of bond, furnish his address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nhis residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[F]<br \/>\n\the will not leave India without the permission of the Court and, if<br \/>\nhe holds a Passport, he shall surrender the same before the trial<br \/>\nCourt within a week;\n<\/p>\n<p>[G]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>\t\tIt<br \/>\nwould be open for the Investigating Agency to apply to the competent<br \/>\nMagistrate for police remand of the applicant.  The applicant shall<br \/>\nremain present before the learned Magistrate on the first date of<br \/>\nhearing of such application and on all subsequent occasions, as may<br \/>\nbe directed by the learned Magistrate.  This would be sufficient to<br \/>\ntreat the accused in the judicial custody for the purpose of<br \/>\nentertaining application of the prosecution for police remand.  This<br \/>\nis, however, without prejudice to the right of the accused to seek<br \/>\nstay against an order of remand, if ultimately granted, and the power<br \/>\nof the learned Magistrate to consider such a request in accordance<br \/>\nwith law. It is clarified that the applicant, even if remanded to the<br \/>\npolice custody upon completion of such period of police remand, shall<br \/>\nbe set free immediately, subject to other conditions of this<br \/>\nanticipatory bail order.\n<\/p>\n<p>\tWith<br \/>\nthese directions, the Application is allowed.
