The following were present:\n<\/p>\n
Appellant: Ms. Kiran Mehta on video conference from NIC-Chandigarh Studio;
\nRespondent: Dr. Lalit Verma, PIO & Registrar-cum-Secretary;\n<\/p>\n
       The Respondent states that the complete information was sent to the Appellant on 18\/02\/2011.
\nThe appellant admits that she has received the complete information sent by the PIO on
\n18\/02\/2011.The RTI application had been filed on 17\/07\/2010 and the PIO sent a letter seeking
\nadditional fees of Rs.42\/- on 18\/06\/2010 much after the lapse of the 30 day period mandated in the
\nRTI Act. Despite this the Appellant paid the some of Rs.42\/- on 05\/07\/2010, however the 21 page
\ninformation was only sent to the Appellant on 18\/02\/2011.\n<\/p>\n
It is clear that the Appellatn has been unnecessarily harassed by the Public Authority in getting the
\ninformation and had to file the second appeal. Harassment of a common man by public authorities is
\nsocially abhorring and legally impermissible. It may harm him personally but the injury to society is
\n far more grievous. Crime and corruption thrive and prosper in the society due to lack of public
\nresistance. Nothing is more damaging than the feeling of helplessness. An ordinary citizen instead of
\ncomplaining and fighting succumbs to the pressure of undesirable functioning in offices instead of
\nstanding against it. Therefore the award of compensation for harassment by public authorities not only
\ncompensates the individual, satisfies him personally but helps in curing social evil. It may result in
\nimproving the work culture and help in changing the outlook.\n<\/p>\n
In view of this the Commission under Section 19(8)(b) of the RTI Act awards a compensation of
\nRs.2000\/- to the Appellant for the loss and detriment suffered by her and getting the information very
\nlate.\n<\/p>\n
Decision:\n<\/p>\n
The Appeal is allowed.\n<\/p>\n
      The information has been provided to the Appellant.\n<\/p>\n
The PIO is directed to ensure that a cheque of Rs.2000\/- as compensation is sent to the
\nAppellant before 15 November 2011.\n<\/p>\n
The issue before the Commission is of not supplying the complete, required information by the
\nPIO within 30 days as required by the law.\n<\/p>\n
From the facts before the Commission it appears that the PIO is guilty of not furnishing information
\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the
\nrequirement of the RTI Act.\n<\/p>\n
It appears that the PIO’s actions attract the penal provisions of Section 20 (1). A showcause notice is
\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty
\nshould not be levied on him.\n<\/p>\n
He will present himself before the Commission at the above address on 29 September 2011 at
\n4.30pm alongwith his written submissions showing cause why penalty should not be imposed on him
\nas mandated under Section 20 (1).\n<\/p>\n
If there are other persons responsible for the delay in providing the information to the Appellant the
\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before
\nthe Commission with him.\n<\/p>\n
This decision is announced in open chamber.\n<\/p>\n
Notice of this decision be given free of cost to the parties.
\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n
