Prasad & Ranjan,JJ:-In a proceeding under Section<\/p>\n
145    of   the    Code    of   Criminal     Procedure,Sub-<\/p>\n
Divisional     Judicial     Magistrate,Patna        by   order<\/p>\n
dated 11.6.1990, directed the husband-respondent<\/p>\n
No.2 Sita Ram Singh to pay to his wife respondent<\/p>\n
no.1   Bimla      Devi,   maintenance   at    the    rate   of<\/p>\n
Rs.500\/- per months. Husband assailed the said<\/p>\n
order before the Revisional Court, but did not
\n                                     2<\/span><\/p>\n
succeed.       Thereafter          he     filed    application          for<\/p>\n
quashing      the    order        of    the   Magistrate         granting<\/p>\n
maintenance         and    the     dismissal       of    the     revision<\/p>\n
application before this Court. It appears from<\/p>\n
the judgment itself,that by order dated 23.6.1992<\/p>\n
passed in the aforesaid case this Court directed<\/p>\n
the     husband      to      pay        Rs.250\/-        per    month    as<\/p>\n
maintenance allowance till the disposal of the<\/p>\n
case.     It is further apparent from the impugned<\/p>\n
judgment that              the    husband     went on depositing<\/p>\n
money    at    the        rate    of     Rs.250\/-       per     month    in<\/p>\n
compliance of the order. However, ultimately the<\/p>\n
aforesaid        criminal              miscellaneous           case     was<\/p>\n
dismissed. Thereafter the wife filed a petition<\/p>\n
for realization of Rs.40,000\/- which was due to<\/p>\n
her as arrears of                maintenance.       She prayed for<\/p>\n
issuance       of     distress           warrant.        The      learned<\/p>\n
Magistrate       directed          for     issuance       of     distress<\/p>\n
warrant       against       the    husband        and    in     execution<\/p>\n
thereof, Flour Mill and Howler were seized. In<\/p>\n
order    to    protect       its        auction    sale,        appellant
\n                                  3<\/span><\/p>\n
Mridula    Devi     claiming         to    be    the   owner     of   the<\/p>\n
Flour Mill and Howler deposited Rs.36750\/-.<\/p>\n
      Appellant alleged that the police illegally<\/p>\n
seized the property belonging to her in execution<\/p>\n
of the distress warrant. Accordingly, she prayed<\/p>\n
for   appropriate             action        against       the     police<\/p>\n
authority and release of the amount.                            Wife in<\/p>\n
response    thereto       stated          that    claim    of    Mridula<\/p>\n
Devi that she is the owner of the property is<\/p>\n
incorrect and in fact she is a concubine of her<\/p>\n
husband     and     in    order        to       deprive         her   the<\/p>\n
maintenance she is claiming to be its owner.<\/p>\n
      The Principal Judge, Family Court, Patna on<\/p>\n
consideration of the materials on record rejected<\/p>\n
her prayer by order dated 13.11.1998 passed in<\/p>\n
Maintenance Case No. 291(M) of 1988.<\/p>\n
      Aggrieved          by    the    same       she   has   preferred<\/p>\n
this appeal.\n<\/p>\n
      Mr.         Dhurb        Narayan,          Senior      Advocate,<\/p>\n
appearing    on     behalf      of     the       appellant      contends<\/p>\n
that the Court below ought to have accepted the<\/p>\n
plea of the appellant that the property belonged
\n                                     4<\/span><\/p>\n
to her and consequently, directed its release and<\/p>\n
the amount deposited by her. In this connection,<\/p>\n
our attention has been                  drawn to the documents<\/p>\n
filed   by      the   appellant          in    the    Court    below.      A<\/p>\n
Chircut      dated 28.8.1997 was filed on behalf of<\/p>\n
the     appellant         showing         that        she     had      paid<\/p>\n
consideration money to the husband for the land<\/p>\n
upon    which      the   machine         room    is    existing.         The<\/p>\n
Court below did not place any reliance on the<\/p>\n
said    document         taking         into    account        that      the<\/p>\n
electricity receipts            have been filed of the year<\/p>\n
1989 and, as such, the plea put fourth by the<\/p>\n
appellant that she paid the consideration money<\/p>\n
to    Sita   Ram      Singh    in       1997    is    not   fit     to    be<\/p>\n
believed.        It observed that when the land was<\/p>\n
sold in the year 1997 how could the receipts of<\/p>\n
the electricity bill of the Mill standing over<\/p>\n
that could be of the earlier years. The Court<\/p>\n
below also took into consideration order dated<\/p>\n
30.4.1998 passed              in Insolvency Case No. 1 of<\/p>\n
1997 which shows that it is the husband who had<\/p>\n
filed     the     Insolvency            case    for     stay      of     the
\n                                 5<\/span><\/p>\n
distress warrant issued by the Family Court.The<\/p>\n
affidavits of three persons supporting her case<\/p>\n
have    been      disbelieved       as     same    came      into<\/p>\n
existence after the dispute has arisen. Not only<\/p>\n
this the amount for release of the property was<\/p>\n
not    deposited by the appellant but the husband’s<\/p>\n
father.\n<\/p>\n
        It is relevant here to state that according<\/p>\n
to the wife, appellant is the concubine of her<\/p>\n
husband and the specific direction was given to<\/p>\n
her    by   the    Court    below   to   state    her   status.<\/p>\n
Despite that she declined to do the same.<\/p>\n
               Taking into account the aforesaid fact<\/p>\n
the Court below came to the conclusion that the<\/p>\n
property     seized    in    execution    of     the    distress<\/p>\n
warrant in fact belonged to the husband and this<\/p>\n
appellant in order to deprive the wife the amount<\/p>\n
of     maintenance     as    claimed     that     to    be   her<\/p>\n
property,      we are of the opinion that the Court<\/p>\n
below on consideration of the materials on record<\/p>\n
rightly held so and no case for interference is<\/p>\n
made out.\n<\/p>\n

            In the result, we do not find any merit in<\/p>\n
      the appeal and it is dismissed with cost which is<\/p>\n
      assessed at Rs.1100\/- to be paid by the appellant<\/p>\n
