     Against the rejection of a private complaint, the<\/p>\n
complainant preferred this revision petition.<\/p>\n
     2.    The case of the complainant is that he had<\/p>\n
purchased 6 goods carriage vehicles on 30.11.2006 through<\/p>\n
an auction sale conducted by accused Nos.1 and 2, the<\/p>\n
Manager and Assistant Collection Officer, HDFC Bank,<\/p>\n
Palarivattom.     The other accused\/respondents are the<\/p>\n
officials of the said bank on various capacities. According<\/p>\n
to the complainant, originally these vehicles were belonged<\/p>\n
to one P.P.Johnson and the vehicles were repossessed by<\/p>\n
the respondents\/accused on the default of the repayment of<\/p>\n
the financial assistance given by the said bank to the said<\/p>\n
person. It is the further case of the complainant that, the<\/p>\n

above vehicles with original R.C.Book were in the name of<\/p>\n
said P.P.Johnson and according to the complaint the<\/p>\n
accused person states that the original R.C.Book were<\/p>\n
surrendered by the R.C.owner and according to the<\/p>\n
complainant he purchased the vehicles on payment of<\/p>\n
Rs.25,68,000\/- believing the assurance of the accused that<\/p>\n
there is no issue with the vehicles and he will get the<\/p>\n
clearance from the concerned authorities. But according to<\/p>\n
the complainant when he applied for NOC, for transfer of<\/p>\n
the vehicles, before the Joint R.T.O, he refused to give NOC<\/p>\n
on the ground that there is a criminal case pending against<\/p>\n
the said Johnson, the original R.C.owner of the vehicles.<\/p>\n
According to the complainant, against the above reply from<\/p>\n
the R.T.O authorities, he approached this Court by filing<\/p>\n
W.P.(C) No.27465\/2007 seeking a direction to declare that<\/p>\n
the vehicles are not involved in any case and for further<\/p>\n
direction to the CBI, directing them to clarify that the<\/p>\n
vehicles need not be produced before any court below, since<\/p>\n

the vehicles are not involved in any other crime.<\/p>\n
Admittedly, the complainant purchased the above vehicles<\/p>\n
as a dealer of used vehicles and he has no business of<\/p>\n
operating the vehicles. The grievance of the complainant is<\/p>\n
that after the purchase of the vehicles on 30.11.2006 he<\/p>\n
could not use the vehicles or sale the same.<\/p>\n
      3.    Upon the complaint preferred by the revision<\/p>\n
petitioner\/complainant, he himself was examined as CW1.<\/p>\n
On the basis of the deposition of the CW1, the complainant<\/p>\n
and the materials produced by him, the learned Magistrate<\/p>\n
came into a conclusion that actually the dispute is civil in<\/p>\n
nature and no criminal liability can be fixed on the<\/p>\n
respondents in connection with the purchase of the vehicles<\/p>\n
and thus, the complaint was rejected under Sec.204.<\/p>\n
      4.    The     learned counsel   submitted   that   the<\/p>\n
accused\/respondents did not inform the complainant that<\/p>\n
the original owner of the vehicles has already been involved<\/p>\n
in criminal case and therefore, the charge against the<\/p>\n

accused under Sections 408, 420, 120B r\/w 34 of I.P.C. will<\/p>\n
lie.\n<\/p>\n
      5.    I have carefully considered the arguments<\/p>\n
advanced by the learned counsel for the petitioner and also<\/p>\n
perused the order impugned.        From the facts which<\/p>\n
elaborately narrated in the impugned order, it can be seen<\/p>\n
that the complainant voluntarily involved in an auction sale<\/p>\n
procedure with respect to the sales of the vehicles which<\/p>\n
were repossessed by the respondents, who are the financial<\/p>\n
agency and who extended financial assistance to the<\/p>\n
original owner of the vehicles and the vehicles were<\/p>\n
repossessed due to the failure on the part of the loanee\/hire<\/p>\n
purchaser. According to the complainant he has no case<\/p>\n
that the accused have persuaded the complainant to<\/p>\n
participate in the auction or they have suppressed any<\/p>\n
material facts from the notice of the complainant with<\/p>\n
respect to the vehicles in question. Now the case of the<\/p>\n
complainant is that the accused\/respondents did not<\/p>\n

disclose to him that the R.C. owner of the vehicles involved<\/p>\n
in criminal cases. When the vehicles put in auction sale<\/p>\n
normally what expected to disclose is the details with<\/p>\n
respect to those vehicles and the auctioneer\/the seller, not<\/p>\n
bound to disclose the details of the original owner of the<\/p>\n
vehicles and his antecedents and back history. It is also<\/p>\n
relevant to note that the above reasoning seems to be<\/p>\n
approved and accepted by the complainant by his prayer<\/p>\n
and averments in the writ petition filed before this Court.<\/p>\n
As correctly pointed out by the learned Magistrate what<\/p>\n
sought in the writ petition was for a declaration that the<\/p>\n
vehicles are not involved in any case and the further<\/p>\n
direction sought was that the CBI be directed to clarify that<\/p>\n
the vehicles need not be produced before any court of law<\/p>\n
since the vehicles are not involved in any crime. Thus, it is<\/p>\n
crystal clear that the vehicles which purchased by the<\/p>\n
complainant from the respondents\/accused, even according<\/p>\n
to the complainant, are not involved in any crime.       The<\/p>\n

learned Magistrate while rejecting the complaint has<\/p>\n
categorically observed that it cannot be imagine that the<\/p>\n
accused were aware, when the auction sale was conducted<\/p>\n
on 30.11.2006 and when the vehicles thus sold to the<\/p>\n
complainant that a criminal case was pending against<\/p>\n
P.P.Johnson, the original owner of the vehicles and Joint<\/p>\n
R.T.O would refuse to issue NOC on the ground that a<\/p>\n
criminal case was pending against the original R.C.owner.<\/p>\n
Therefore, I find no illegality or irregularity on the finding of<\/p>\n
the learned Magistrate that absolutely there is no materials<\/p>\n
to show that the accused had dishonest or fraudulent<\/p>\n
intention to cheat the complainant or dishonestly or<\/p>\n
fraudulently induced the complainant to purchase the above<\/p>\n
vehicles in an auction sale conducted on 30.11.2006. It is<\/p>\n
also pertinent to note that the vehicles in question sold in a<\/p>\n
public auction and for that sole reason it cannot be hold for<\/p>\n
a moment that accused maintain an intention to cheat the<\/p>\n
complainant.\n<\/p>\n

                                : 7 :<\/span><\/p>\n
            In the light of the above facts and circumstances,<\/p>\n
I am of the view that the learned Magistrate is perfectly<\/p>\n
legal in rejecting the complaint and accordingly this<\/p>\n
revision petition is devoid of any merit and the same is<\/p>\n
dismissed accordingly.\n<\/p>\n<\/p>\n
