The grievance raised by      the<br \/>\n     petitioner is that the directions issued by the Court of<br \/>\n     2nd Jt. Civil Judge, (J.D.), Navsari in his judgment and<br \/>\n     decree dated 26th April, 2002 in Regular Civil Suit No.<br \/>\n     160 of 1999 have not been implemented by the respondent<br \/>\n     Municipality and, therefore, these petitions have been<br \/>\n     filed. Learned advocate Mr. Dhirendra Mehta appearing<br \/>\n     for the respondent Municipality has submitted that the<br \/>\n     affidavit in reply has been filed by the respondent<br \/>\n     Municipality in Special Civil Application No.    7698 of<br \/>\n     2002.   As regards the grievance raised by the petitioner<br \/>\n     about non implementation of the order passed by the civil<br \/>\n     court, it was submitted by him that the petitioner should<br \/>\n     approach the concerned civil court for execution of the<br \/>\n     order passed by the civil court and the present writ<br \/>\n     petitions for execution of the orders of the civil court<br \/>\n     are not maintainable.\n<\/p>\n<p> Considering the averments made in the present<br \/>\npetitions and also considering the submissions made by<br \/>\nthe learned advocates for the parties, I am of the view<br \/>\nthat if the petitioner has any grievance about the non<br \/>\ncompliance of the directions issued by the civil court,<br \/>\nthen, for such non compliance and for execution of such<br \/>\ndirections, the petitioners should approach the concerned<br \/>\ncivil court and in such cases, writ petition is not<br \/>\nmaintainable.   Therefore, these    two    petitions  are<br \/>\ndismissed without observing anything on merits of the<br \/>\nmatter. It will, however, be open for the petitioner to<br \/>\napproach the civil court concerned in respect of the<br \/>\ngrievance voiced in these petitions. Both the petitions<br \/>\nare, therefore, disposed of accordingly. Notice issued<br \/>\nin Special Civil Application No.        7698 of 2002 is<br \/>\ndischarged.
