Application No. 10293<br \/>\nof 2009 dated 10.9.2009.  Condition No. 30(e) reads as under:\n<\/p>\n<p>\t&#8220;30(e).\n<\/p>\n<p> to surrender his passport, if any, to the   lower court,<br \/>\nwithin a week.&#8221;\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr. Savjani for the applicant has stated that as stated in<br \/>\ndetail in his application, the applicant who is a businessman desires<br \/>\nto visit abroad for the purpose of his business and therefore his<br \/>\npassport may be released.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel Mr. R.J. Oza for respondent No. 2-Union of India has resisted<br \/>\nthe application and submitted that it is causing delay as he has not<br \/>\nyet filed the reply\/written submissions.  He also submitted that<br \/>\nafter it is filed, the adjudication proceedings will take place on<br \/>\nthe basis of which further course of action could be decided. He<br \/>\ntherefore submitted that the present application for deletion of the<br \/>\ncondition may not be entertained. However, the alternate prayer for<br \/>\nlimited period may be considered by suitable terms.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Ms. Shah has also resisted the application.\n<\/p>\n<p>5.\tIn<br \/>\nview of rival submissions, since the prayer for deletion of condition<br \/>\nNo. 30(e) cannot be entertained and as it has been requested by<br \/>\nlearned advocate Mr. Savjani that it may be confined to modification<br \/>\nof the condition for a limited period to enable the applicant to<br \/>\nvisit abroad requires to be considered.\n<\/p>\n<p>6.\tTherefore,<br \/>\nhaving regard to the facts and circumstances and considering the fact<br \/>\nthat the prayer is now confined only to modification of the<br \/>\ncondition\/suspension of the condition for a limited period to enable<br \/>\nhim to visit abroad for the purpose of business, it  deserves to be<br \/>\nallowed.    The passport deposited by the applicant before the court<br \/>\nbelow is ordered to be handed over to the applicant to enable him to<br \/>\ntake further steps for  his visit abroad.\n<\/p>\n<p>7.\tHowever,<br \/>\nat the time of release of the passport, the applicant shall give a<br \/>\nxerox copy as well as complete itinerary and contact Nos. with the<br \/>\ndetails of his programme abroad.  A copy of the same shall also be<br \/>\ngiven to respondent No. 2.   It is also clarified that the passport<br \/>\nis ordered to be released to enable him to make arrangement for his<br \/>\nvisit abroad for a limited period up to 30.10.2011. The applicant<br \/>\nshall return to India on or before 30.10.2011 and on his arrival he<br \/>\nshall surrender his passport within a week, that is, on or before<br \/>\n7.11.2011 before the lower court without fail.  All other conditions<br \/>\nshall remain unaltered.\n<\/p>\n<p>\tThe<br \/>\napplication is accordingly allowed. Rule is made absolute to the<br \/>\naforesaid extent.  D.S.
