\nDinakaran dated 25.07.2005 made in W.P.M.P.Nos.24667 and 24668
\nof 2005 in W.P.No.20491 of 2004 respectively.\n<\/p>\n
           Writ  Petition is filed under Article  226  of  the
\nConstitution  of  India  praying for issuance  of  a  Writ  of
\nMandamus as stated therein.\n<\/p>\n

                        COMMON JUDGMENT<\/p>\n
  (Judgement of the Court was delivered by P. SATHASIVAM,J.)<\/p>\n
     The above writ appeals are directed against the orders of<\/p>\n
the   learned   single   Judge  dated   25.07.2005   made   in<\/p>\n
W.P.M.P.Nos.24667  and 24668 of 2005 in W.P.No.20491  of  2004<\/p>\n
respectively, in and by which the learned Judge, after finding<\/p>\n
that the grievance of the petitioner and the relief sought for<\/p>\n
cannot  be  gone  into by this Court, exercising  jurisdiction<\/p>\n
under  Article  226  of the Constitution of  India,  dismissed<\/p>\n
those petitions.\n<\/p>\n
       2.   Considering  the  fact  that  the   appellant\/writ<\/p>\n
petitioner is appearing in person, we heard her at length.  We<\/p>\n
also  heard learned Special Government Pleader for respondents<\/p>\n
1 to 6.\n<\/p>\n
       3.   Pursuant   to  our  direction  dated   05.01.2007,<\/p>\n
respondents  7,  8, 9 and 11 appeared before this  Court.   We<\/p>\n
also enquired and heard their grievance.\n<\/p>\n
      4.  Inasmuch  as the parties are not willing  to  engage<\/p>\n
counsel,  we ourselves verified the relief prayed for  in  the<\/p>\n
main writ petition.  The prayer in the writ petition reads  as<\/p>\n
under.\n<\/p>\n
         ”  to issue a writ of Mandamus or any other<\/p>\n
         appropriate  writ, order or  direction,  in<\/p>\n
         the  nature  of  a writ to direct  the  5th<\/p>\n
         respondent  to cancel all the documents  of<\/p>\n
         the  petitioner’s property situated  in  M.<\/p>\n
         Pappampatti,     Moperipalayam     Village,<\/p>\n
         Palladam  T.K.  (1)  S.No.713\/15  (As   per<\/p>\n
         patta  Survey No.715\/A, extent of 81  cents<\/p>\n
         landed property’s documents forged by  late<\/p>\n
         by  Velusamy  and his son Sivasamy  in  the<\/p>\n
         year  1994  onwards  (2)  Survey  No.394\/3,<\/p>\n
         395\/2B,  395\/3B,  395\/5A  extent  of   2.13<\/p>\n
         acres  landed  property’s documents  forged<\/p>\n
         by  Gurusamy son of Narayana Gounder in the<\/p>\n
         year   1996  onwards  (3)  Survey  No.702\/2<\/p>\n
         extent  of  87  +  cents landed  property’s<\/p>\n
         documents  forged by Rockiappa Gounder  son<\/p>\n
         of  (Late) Marappa Gounder in the year 2001<\/p>\n
         onwards  (4)  A  tiled house property  door<\/p>\n
         No.8   (Old  No.)  Pillayar  Koil   Street,<\/p>\n
         Pappampatti,     Moperipalayam     Village,<\/p>\n
         Palladam  Taluk  it’s will document  forged<\/p>\n
         by   Subbanna  Gounder  son  of   Ganapathy<\/p>\n
         Gounder   in   the   year   2001   onwards,<\/p>\n
         consequently  to register  the  above  said<\/p>\n
         properties  in  favour of the  petitioner’s<\/p>\n
         name.<\/p><\/blockquote>\n
      5. During the course of hearing the learned single Judge<\/p>\n
(F.M.  Ibrahim Kalifulla,J.) by order dated 15.03.2005, passed<\/p>\n
the following order.\n<\/p>\n
          ”     The Registry is directed to gather a
\n          report  from the Principal District Judge,
\n          Coimbatore as to the stages at  which  the
\n          proceedings referred to in this  petition,
\n          pending   on  the  file  of  the  Judicial
\n          Magistrate,  Avinashi as on this  date  in
\n          order   to  enable  this  Court  to   pass
\n          appropriate orders.  The report  shall  be
\n          collected  from  the  Principal   District
\n          Judge, Coimbatore in four weeks time.\n<\/p><\/blockquote>\n
               Post the writ petition on 12.04.2005.
\n          ”\n<\/p><\/blockquote>\n
<\/blockquote>\n
When  the matter again came up for hearing on 25.07.2005,  the<\/p>\n
learned  single Judge (P.D. Dinakaran,J.) directed the learned<\/p>\n
Principal  District Judge, Coimbatore, to give effect  to  and<\/p>\n
pass  appropriate orders as ordered on 15.03.2005  and  closed<\/p>\n
WPMP.No.24667 of 2004.\n<\/p>\n
      6. Pursuant to the said direction, the learned Principal<\/p>\n
District   Judge,  Coimbatore  forwarded  the  reports   dated<\/p>\n
14.11.2005  and 16.11.2005 received from the District  Munsif-\n<\/p>\n
cum-Judicial   Magistrate,  Avanashi  in  respect   of   First<\/p>\n
Information Report in Crime Nos.344\/2000, 243\/1999,  254.2001,<\/p>\n
308\/2003  and  206\/2003, which were pending  on  the  file  of<\/p>\n
District   Munsif-cum-Judicial  Magistrate,   Avanashi.    The<\/p>\n
following details are available in the said reports.\n<\/p>\n

\n                                 was  recalled.  Thereafter
\n                                 the            complainant
\n                                 continuously  absent  from
\n                                 19.1.2006.   Notices  were
\n                                 issued to the complainant.<\/p>\n
                                 The  case  was  posted  on
\n                                 12.12.2006. On  12.12.2006
\n                                 also  the complainant  was
\n                                 absent. A2 present and  A3
\n                                 to    A5    were   absent.\n<\/p>\n
                                 Petition  U\/s.317  Cr.P.C.\n<\/p>\n
                                 Was  filed and allowed for
\n                                 A3 and A4.  NBW was issued
\n                                 to  A5.   Now the case  is
\n                                 posted  to  11.1.2007  for
\n                                 production    of     death
\n                                 certificate of A1 and  for
\n                                 execution   of   the   NBW
\n                                 against A.5.\n<\/p>\n
 2  CC.322 of Karumathampatty      On    22.11.2005,    after
\n       2002   Police       Station clubbing   the   complaint
\n             Cr.No.243\/99         given      by      defacto
\n             U\/s.326, 323 IPC.    complainant,   other   two
\n                                 accused  namely  Nanjammal
\n                                 and  Thulasimani added  as
\n                                 A3 and A4 and summons were
\n                                 issued.   As  the  summons
\n                                 were refused by A3 and A4.\n<\/p>\n
                                 NBW were issued against A3
\n                                 and   A4.   On  19.1.2006,
\n                                 after getting anticipatory
\n                                 bail,  A4 surrendered.  On
\n                                 7.2.06,     the      death
\n                                 certificate  for  A3   was
\n                                 filed  and charge  against
\n                                 A3  abated.  On 29.5.2006,
\n                                 copies  were given to  the
\n                                 accused.  On 30.5.06,  the
\n                                 accused denied the  charge
\n                                 and the case was posted to
\n                                 1.6.06.     The    defacto
\n                                 complainant  was  examined
\n                                 as   PW1  in  part.    PW1
\n                                 refused  to  complete  the
\n                                 Chief  examination.  Later
\n                                 PW2  to PW5 were examined.\n<\/p>\n
                                 Now the case is posted  to
\n                                 11.1.07  on the production
\n                                 of witnesses 2,5 and 6.\n<\/p>\n
 3  CMP.3243   Karumathampatty      Even     after     several
\n   of 2002    Police       Station adjournments  for  enquiry
\n             Cr.No.254\/01.        u\/s.202    Cr.P.C.,    the
\n                                 complainant    has     not
\n                                 produced   any  witnesses.\n<\/p>\n
                                 Hence,  as a last  chance,
\n                                 the  case is adjourned  to
\n                                 11.1.2007.\n<\/p>\n
 4  STC.2177o  Karumathampatty      The  trial  commenced   on
\n   f 2003     Police       Station 23.2.2006.   Pws.1  to   7
\n             Cr.No.206\/2003       have been examined and the
\n             U\/s.341,  323,   506 prosecution side is closed\n<\/p>\n
             (ii) IPC.            on 5.12.2006.  The accused
\n                                 was     questioned    U\/s.\n<\/p>\n
                                 313(1)(b) Cr.P.C.  Now the
\n                                 case   stands  posted   to
\n                                 2.1.2007  for  examination
\n                                 of defence side witnesses.\n<\/p>\n
 5  CC.24 of   Karumathampatty      The District Munsif-cum-
\n   2004       Police       Station Judicial Magistrate,
\n             Cr.No.308\/2003.      Avinashi in her earlier
\n                                 report has submitted that
\n                                 the case in Cr.No.308\/2003
\n                                 has been filed u\/s.379 IPC
\n                                 for theft of a Moped.  The
\n                                 complainant of that case
\n                                 is Sheik Ameen S\/o.Kotabai
\n                                 and not related to the
\n                                 petitioner Palaniammal.\n<\/p>\n
                                 The case taken on file as
\n                                 C.C.24\/2004 has been
\n                                 disposed off on 24.2.2004.\n<\/p>\n
       7.  Today,  we  once  again  heard  the  appellant\/writ<\/p>\n
petitioner in detail.  We also heard respondents 7, 8,  9  and<\/p>\n
11,  who were present before us.  In spite of our request  and<\/p>\n
persuasion  for  engaging counsel, appellant\/writ  petitioner,<\/p>\n
who  appeared in person is not willing to accept our  request.\n<\/p>\n
She   repeatedly  represented  that  her  complaint  regarding<\/p>\n
forgery  may be enquired and appropriate action may  be  taken<\/p>\n
against  the  person  concerned.   From  the  reports  of  the<\/p>\n
District Munsif-cum-Judicial Magistrate, Avanashi, it is clear<\/p>\n
that the complaints made by the appellant\/writ petitioner  are<\/p>\n
pending  before  the concerned Court.  In such  circumstances,<\/p>\n
the  grievance expressed by the petitioner cannot be gone into<\/p>\n
by this Court.  We are satisfied that ends of justice would be<\/p>\n
met  by  directing  the  learned District  Munsif-cum-Judicial<\/p>\n
Magistrate,  Avanashi to give priority to the above  mentioned<\/p>\n
pending  cases,  viz., CC.99\/2005, CC.322\/2000,  CMP.3243\/2002<\/p>\n
and  STC.2177\/2003, and dispose of the same  one  way  or  the<\/p>\n
other,   after  affording  opportunity  to  all  the   parties<\/p>\n
concerned.   The  appellant\/writ petitioner,  is  directed  to<\/p>\n
cooperate  for the early disposal of the above  cases.   After<\/p>\n
disposal  of the above said matters, learned District  Munsif-\n<\/p>\n
cum-Judicial  Magistrate, Avanashi is  directed  to  submit  a<\/p>\n
report to this Court on or before 30.04.2007.\n<\/p>\n
      8.  In  view of the reasons stated above, the relief  as<\/p>\n
claimed  by  the  petitioner in the writ  petition  cannot  be<\/p>\n
granted by this Court, however, our direction mentioned  above<\/p>\n
would  satisfy the petitioner.  It is made clear that  in  the<\/p>\n
above   mentioned  proceedings,  if  the  complaint  regarding<\/p>\n
forgery  is proved, it is open to the writ petitioner to  take<\/p>\n
appropriate  action  against the persons concerned.  With  the<\/p>\n
above observation, the writ appeals and the writ petition  are<\/p>\n
closed.   No  costs.    Consequently, connected  miscellaneous<\/p>\n
petitions are also closed.\n<\/p>\n
      Post  all  these  matters on 04.06.2007,  for  reporting<\/p>\n
compliance.\n<\/p>\n
