I find that the similar orders\n\nas challenged in the case of Rashpinder Kaur (supra)\n\nhave been challenged in this petition.\n\n                   In the case of Rashpinder Kaur (supra),\n\nthe following order had been passed:-\n\n                         \"Facts<\/pre>\n
 in brief are that by virtue of an advertisement
\n                   issued by the State of Punjab, Department of Education,
\n                   9998 posts of Teaching Fellows were advertised. In about
\n                   400 cases, the respondents prima faice found that the
\n                   experience certificate(s)\/documents appended with the
\n                   Application Forms was\/were bogus (forged and
\n                   fabricated). So as to give an opportunity to such persons,
\n CWP No.16606 of 2009                                           [4]<\/p>\n
                   an advertisement was given by the respondents to enable
\n                   all such persons to appear before a Committee to establish
\n                   that the certificate(s) infact was\/were genuine.\n<\/p>\n
                         In all the cases that have flooded the Court, the
\n                   respondents have passed orders cancelling the agreement
\n                   of appointment, thereby removing the persons from
\n                   service with immediate effect. While passing the orders,
\n                   reference has been made only to the certificate(s) that
\n                   purportedly was\/were found to be forged\/ fabricated.\n<\/p>\n
                          The writ petitions have been filed in challenge to the
\n                   orders of removal on various grounds including that the
\n                   petitioners have been allowed to serve for about a year
\n                   whereafter the impugned action has been taken; the
\n                   certificate(s) that had been termed as bogus (forged and
\n                   fabricated) was\/ were infact genuine as is evident from the
\n                   documents appended with the writ petitions.\n<\/p>\n
                          It has been specifically pleaded that the documents
\n                   placed on record with the writ petitions in support of
\n                   genuineness of the certificate(s), were produced before the
\n                   Committee. No notice of the documents has however been
\n                   taken by the administrative authorities; every individual is
\n                   vested with a right on issuance of a letter of appointment;
\n                   the orders passed by the respondents are cyclostyled
\n                   orders and do not deal with the individual case of the
\n                   petitioners, as projected by them; reasoned and speaking
\n                   orders have not been passed; and proper opportunity of
\n                   hearing has not been given.\n<\/p>\n
                         In the petitions earlier filed on the grounds given
\n                   above, the matters had been adjourned to 10.11.2009 after
\n                   issuance of notice of motion.\n<\/p>\n
                          The matters that are being taken up today, have been
\n                   shown in urgent list and are being disposed of in view of
\n                   the stand taken by the learned counsel for the respondent-
\n                   State.\n<\/p>\n
                          Learned counsel appearing for the respondents
\n                   contends that the respondents, considering the facts and
\n                   circumstances of the cases, have taken a decision to
\n                   review\/ reconsider the cases of all the persons who want to
\n                   bring evidence\/ material to show that the documents\/
\n                   certificates submitted by the petitioners were genuine. In
\n                   pursuance of this exercise, an advertisement has already
\n                   been given in `The Tribune\u201f and \u201ePunjab Kesri\u201f on
\n                   30.10.2009 and Punjabi daily `Ajit\u201f dated 31.10.2009. The
\n                   public notice makes it evident that all the persons who
\n                   have been removed from service on the ground of relying
\n                   on bogus (forged and fabricated) certificates, belonging to
\n                   the areas (except District Gurdaspur) are required to
\n                   appear in the Office of Bharat Scouts Guide, Near Law
\n                   Department, Panjab University, Chandigarh at 10.00 A.M.
\n                   The persons from District Gurdaspur are required to
\n                   appear on 5.11.2009.\n<\/p>\n
                         Learned counsel has further informed the Court that
\n CWP No.16606 of 2009                                          [5]<\/p>\n
                   a Committee has been constituted which shall accept the
\n                   representations\/ documents to be submitted in support of
\n                   claim of each person. While accepting the documents, a
\n                   receipt duly signed by authorised signatory would be
\n                   given for each of the documents. On considering claim of
\n                   each person, after verification of the documents so
\n                   submitted, a reasoned and speaking order would be
\n                   passed.\n<\/p>\n
                         Learned counsel further states that on account of
\n                   paucity of time, another public notice would be given by
\n                   way of a corrigendum or otherwise, asking the removed
\n                   persons to come present and project their case as detailed
\n                   above.\n<\/p>\n
                         Learned counsel has assured the Court that speaking
\n                   and reasoned orders would be passed in regard to each of
\n                   the individual cases and the same shall be conveyed to the
\n                   concerned persons.\n<\/p>\n
                         In view of the stand taken on behalf of the
\n                   respondent-State, it transpires that the impugned orders are
\n                   required to be reviewed\/ reconsidered by the respondents.
\n                   Under the circumstances, cause of action does not survive
\n                   in so much as fresh decision vide reasoned and speaking
\n                   orders, would be taken by the respondents after
\n                   considering the individual claim of the petitioners\/
\n                   candidates.\n<\/p>\n
                          In view of the above, the petitions are disposed of
\n                   with direction to the respondents to complete the process
\n                   as soon as possible, in the interest of administrative
\n                   efficiency.\n<\/p>\n
                          Learned counsel for the petitioners contends that
\n                   some such persons have not been relieved and continue to
\n                   serve.\n<\/p>\n
                         If that be so, it is directed that the persons not
\n                   relieved till date as a consequence of the orders of
\n                   removal, would be allowed to continue to serve till orders
\n                   are passed by the respondents on review\/ reconsideration
\n                   of the claims.”\n<\/p>\n
                   On         consideration                  of          facts\n\ncollectively,          it   transpires           that      persons         from\n\nareas    other     than     District          Gurdaspur,            would     be\n\n<\/pre>\n
given an opportunity of presenting their case on<\/p>\n
4th November, 2009 at 10.00 AM in the Office of<\/p>\n
Bharat Scouts Guide, near Law Department, Panjab<\/p>\n
University, Chandigarh, while the persons from
\n CWP No.16606 of 2009                                       [6]<\/p>\n
District Gurdaspur can approach the Committee on<\/p>\n
5th November, 2009. Another corrigendum\/ public<\/p>\n
notice would also be given to enable any left out<\/p>\n
candidate         whose      documents        have       been        found<\/p>\n
suspicious.           The     respondents          as      per      their<\/p>\n
undertaking         would      pass     speaking        and       reasoned<\/p>\n
orders       after      consideration         of     the         documents<\/p>\n
submitted by the candidates.\n<\/p>\n
                     In     view   of   the    above,         all    these<\/p>\n
cases are disposed of in the same terms as Civil<\/p>\n
Writ Petition No.16683 of 2009, `Rashpinder Kaur vs. State of Punjab<\/p>\n
& Others’,<\/a> decided on 3.11.2009, portion whereof<\/p>\n
has been reproduced above.\n<\/p>\n

file of the connected cases taken up today.\n<\/p>\n
